  • Against the backdrop of intensifying global climate change responses and marine scientific research, Argo floats—as critical components of autonomous ocean observation networks—play an indispensable role in marine environmental monitoring and climate forecasting. However, their “autonomous drifting” technical characteristics create an adaptive conflict with the existing international legal framework centered on traditional vessels. This paper focuses on the legal issues surrounding Argo floats. Starting from the challenges in determining their legal status and the jurisdiction issues within exclusive economic zones (EEZ), it conducts a theoretical analysis to explore the maritime legal characterization of Argo floats. Subsequently, based on this characterization, it further clarifies the applicable legal rules. Finally, the paper proposes strategies to resolve these legal dilemmas at both the international and domestic levels. This paper takes the United Nations Convention on the Law of the Sea (UNCLOS) as its foundational legal basis. It synthesizes relevant rules from climate law, resolutions of the Intergovernmental Oceanographic Commission (IOC) of UNESCO, and domestic legislative practices in countries such as China, the United States, and Japan to systematize the primary norms concerning Argo floats.Regarding the legal status of Argo floats, this paper first clarifies the concept of marine scientific research. By comparing the core characteristics of marine scientific research, hydrographic surveys, and military surveys, it delineates their fundamental meanings, clearly defines their interrelationships, and reasonably distinguishes their boundaries. Based on the inherent characteristics of Argo floats, the paper clarifies their legal status. It confirms that Argo float operations fall under the category of marine scientific research as defined by UNCLOS. Finally, by examining three core elements—“navigational capability, transport function, and propulsion system”—it demonstrates the legal distinctions between Argo floats and traditional vessels, establishing that Argo floats do not fall under the legal framework applicable to conventional ships.Regarding coastal states' jurisdiction over Argo float activities within the Exclusive Economic Zone (EEZ), this study conducts systematic research across three dimensions: military purpose identification, legal applicability challenges, and ecological conservation. As a critical scientific platform within the global ocean observation system, Argo floats face covert military espionage attempts by certain entities disguised as legitimate research. These entities exploit compliant floats to steal data, posing latent threats to coastal states' sovereign security. The technical characteristics of these floats—autonomous drifting, large-scale deployment, and cross-border movement—create significant compatibility conflicts with the UNCLOS traditional notification system and relevant Argo implementation principles. Jurisdictional disputes in overlapping maritime areas complicate the reporting, approval processes, and rule application for Argo floats. Furthermore, environmental pollution risks throughout the Argo floats lifecycle, coupled with challenges in transboundary pollution diffusion and recovery of failed floats, present novel challenges to coastal states' effective exercise of ecological jurisdiction. To address these challenges, this paper proposes regulatory pathways for Argo float activities from both international and domestic legal perspectives, based on an analysis of existing legal frameworks: At the international level, strengthen the legal binding force of Resolution XX-6: The Argo Project and resolve the legal characterization of Argo floats through interpretation and flexible application of UNCLOS provisions. At the domestic level, it advocates for the formulation of Regulations on the Management of Foreign-Related Ocean floats to regulate such activities. For reporting requirements concerning ocean floats in overlapping maritime areas, regional joint supervision and enforcement approaches can be adopted. To effectively address marine pollution risks from Argo floats, the paper proposes strengthening environmental protection responsibilities throughout their entire lifecycle, clarifying the pollution prevention obligations of deploying entities, the responsibility for retrieving failed floats, and liability for ecological damage compensation. To advance marine monitoring initiatives and safeguard China's maritime rights and interests, active participation in international cooperation within the marine observation domain is essential.
