摘要:

劳动法的发展与技术进步、劳动组织形态的演变密切相关。自工业革命以来,技术、劳动组织与劳动法三者相互作用,共同推动劳动法制度的发展。在数字技术与人工智能广泛应用的背景下,技术所推动的劳动组织变革对现行劳动法体系提出了新的挑战。技术进步改变了用工方式和生产过程的管理手段,使劳动法在部分领域面临适用困难。单纯依靠局部规则调整或扩大个别条文解释,已难以充分回应技术发展带来的结构性变化。解决问题的关键,在于厘清技术、劳动组织与劳动法之间的内在关联,并以此为基础推动劳动法理念与制度的系统调适。全文除引言和结语外,分为五章。第一章考察技术变革进程中劳动组织形态的演变及劳动法律制度的相应调整。技术变革不断改变生产方式和劳动组织形式,催生新的法律调整需求,劳动法则在不同历史阶段作出回应,二者形成持续互动。十八世纪后期至二十世纪后期,动力技术的数次革新引发劳动组织深刻变化:水力和蒸汽动力推动工厂制度产生,电力技术促成科层制管理,流水线技术稳定大规模生产,信息技术则带来组织扁平化与生产分散化。每一次技术革新均会影响劳动过程、劳动关系及劳动者权益保护,并进一步提出新的法律规制需求。从早期工厂立法,到职业安全、工伤赔偿制度建立,再到劳动关系协调制度和社会保障制度的发展,劳动保护范围不断扩大,劳动法体系逐步完善。二十世纪后期以来,随着劳动形态多样化,劳动法开始对非典型用工关系进行更具弹性的调整,并逐步将其纳入规范保护范围。第二章基于历史经验归纳,从技术、劳动组织与劳动法三个维度展开分析。在梳理公共管理常用理论中“技术—制度—组织”分析框架的基础上,对三者关系的既有理解进行重新审视。技术是引发劳动领域变革的重要因素,主要通过改变劳动工具、重塑信息传递方式和引入新职业风险产生影响,应从劳动过程系统的角度进行法学界定。劳动组织作为技术与劳动法之间的桥梁,既是技术应用场所,也是劳动关系展开的平台,从法律角度可视为分工协作的法律表现形式及整合技术因素的制度安排。劳动法则是对技术应用和组织运行中的权利义务关系进行规范的规则体系,以保护劳动者合法权益为基本宗旨。三者的作用机制可归纳为:技术通过改变劳动工具和生产流程,影响信息传递与监督管理方式,进而影响劳动组织形态与劳动法适用;劳动组织作为技术应用的现实载体,其内部结构决定权力利益分配格局,其策略选择成为技术变迁与劳动法律实践之间的关键环节;劳动法则为技术应用和组织运行划定规范边界,确认并调整组织内部权利义务关系,并通过法律解释与制度续造保持对技术发展的适应性。第三章运用上述视角,分析数智时代劳动法面临的具体问题。算法在劳动管理与决策中日益重要,数据成为生产过程评价的基本要素,自动化设备开始替代部分人力。平台借助数字技术连接劳动力与工作任务,用工规模与工时安排更趋灵活,工作过程管理与劳动成果使用在空间上分离。在劳动关系认定上,算法指令削弱人工指挥监督,使人格从属判断困难;收入来源多样化与生产资料提供方式变化,使经济从属适用条件模糊;劳动者组织归属感降低、组织边界模糊,也增加了组织从属判断的难度。在劳动者权益保护上,随时待命的工作方式与碎片化工时冲击工时计算和休息权落实,动态调整的计件单价影响工资支付确定性,数字监控的合理范围仍待明确。在劳动关系协调中,平台企业、外包主体、合作机构和个人劳动者等多方主体并存,使协商主体识别、信息披露和责任分配更加复杂;算法规则、数据使用和评价机制成为劳动关系治理的新议题,劳动者地域分散也影响利益表达和沟通协调机制的形成。上述问题的产生,源于技术应用周期短于法律调整周期、技术运作隐蔽性导致监管取证困难,新型用工形态超出传统劳动关系范畴,算法管理下程序性权利与救济途径不足,以及工业时代形成的劳动法概念体系难以涵盖技术介入后的新权利诉求。第四章的理论逻辑是:应在坚持人格尊严与实质公平两项基本价值的基础上,通过技术治理与责任分配的规则设计,实现价值理念的制度化,推动劳动法回应数智技术挑战。数智技术促使用工形态多样化与管理手段技术化,但并未动摇劳动法的价值基础,反而凸显了保护劳动者人格尊严、纠正劳动关系结构性失衡的必要性。劳动者不应被视为技术系统中的数据对象,其工作自主性、人格利益和精神安宁应获得制度保障;法律也应对不同用工形态下的劳动者给予相应保护,防止技术介入加剧既有地位不平等。基于上述价值立场,法律保护方式应随之调整:保护内容从固守特定岗位转向促进劳动者能力持续发展,以应对技术更新带来的职业替代;规范方式应坚守健康、安全、尊严等底线规则,在保持法律刚性的同时为多样化用工形式留出弹性空间,避免法律僵化而脱离实际。规则设计应协调技术工具与人本价值的关系,将劳动法基本要求嵌入技术系统设计,防止技术成为规避义务的工具;同时强化程序透明,保障劳动者了解并质疑影响自身权益的决策过程。在责任归属上,应以实际控制力与收益归属补充形式归责,建立可追溯的责任识别和合理分担机制,确保实际支配劳动过程并从中获益的主体承担相应法律义务。第五章从基础法律关系、个体权利保护、劳动关系协同治理三个方面,提出数智时代劳动法回应新用工形态的规则调整思路。数字技术介入导致劳动过程管理方式与责任分配方式发生结构性变化,劳动法律制度须对此予以回应。在基础法律关系层面,核心是劳动关系认定标准的调整。传统二分法难以涵盖平台用工等新形态,应将数据指标纳入现有认定体系,以算法管理下的关键数据表现作为判断从属性的参考因素。在此基础上,可构建分层分类的保障体系,使保障水平与用工方式相适应。阶梯式失业保险、终身技能账户等制度设计,其功能在于打破“全有或全无”的传统保障模式,在提高制度灵活性的同时保持基本制度的刚性。在个体权利层面,重点是完善算法管理下的程序性权利。针对劳动者对影响自身权益的决策过程缺乏知情与申诉途径的问题,应对算法备案实行分层义务,创建适用于劳动场景的算法审计标准,保障劳动者在算法决定过程中的说明请求、异议表达和人工复核权利。灵活就业人员社会保障、技能发展支持亦需同步跟进。在劳动关系协同治理层面,核心是沟通、协商与责任协调机制的创新。针对用工形态突破单一企业范围、个体劳动者议价能力降低的问题,应确立以实质影响为标准的关联主体信息披露规则,厘清用工链条责任;探索建立跨区域、跨平台的授权代表和行业性沟通机制,以回应平台化、网络化用工趋势;同时,将算法规则制定、数据使用边界、评价机制调整和申诉处理程序纳入制度化沟通框架,形成兼顾效率、秩序与劳动者权益保护的数智劳动关系治理模式。

  • 劳动法的发展与技术进步、劳动组织形态的演变密切相关。自工业革命以来,技术、劳动组织与劳动法三者相互作用,共同推动劳动法制度的发展。在数字技术与人工智能广泛应用的背景下,技术所推动的劳动组织变革对现行劳动法体系提出了新的挑战。技术进步改变了用工方式和生产过程的管理手段,使劳动法在部分领域面临适用困难。单纯依靠局部规则调整或扩大个别条文解释,已难以充分回应技术发展带来的结构性变化。解决问题的关键,在于厘清技术、劳动组织与劳动法之间的内在关联,并以此为基础推动劳动法理念与制度的系统调适。全文除引言和结语外,分为五章。第一章考察技术变革进程中劳动组织形态的演变及劳动法律制度的相应调整。技术变革不断改变生产方式和劳动组织形式,催生新的法律调整需求,劳动法则在不同历史阶段作出回应,二者形成持续互动。十八世纪后期至二十世纪后期,动力技术的数次革新引发劳动组织深刻变化:水力和蒸汽动力推动工厂制度产生,电力技术促成科层制管理,流水线技术稳定大规模生产,信息技术则带来组织扁平化与生产分散化。每一次技术革新均会影响劳动过程、劳动关系及劳动者权益保护,并进一步提出新的法律规制需求。从早期工厂立法,到职业安全、工伤赔偿制度建立,再到劳动关系协调制度和社会保障制度的发展,劳动保护范围不断扩大,劳动法体系逐步完善。二十世纪后期以来,随着劳动形态多样化,劳动法开始对非典型用工关系进行更具弹性的调整,并逐步将其纳入规范保护范围。第二章基于历史经验归纳,从技术、劳动组织与劳动法三个维度展开分析。在梳理公共管理常用理论中“技术—制度—组织”分析框架的基础上,对三者关系的既有理解进行重新审视。技术是引发劳动领域变革的重要因素,主要通过改变劳动工具、重塑信息传递方式和引入新职业风险产生影响,应从劳动过程系统的角度进行法学界定。劳动组织作为技术与劳动法之间的桥梁,既是技术应用场所,也是劳动关系展开的平台,从法律角度可视为分工协作的法律表现形式及整合技术因素的制度安排。劳动法则是对技术应用和组织运行中的权利义务关系进行规范的规则体系,以保护劳动者合法权益为基本宗旨。三者的作用机制可归纳为:技术通过改变劳动工具和生产流程,影响信息传递与监督管理方式,进而影响劳动组织形态与劳动法适用;劳动组织作为技术应用的现实载体,其内部结构决定权力利益分配格局,其策略选择成为技术变迁与劳动法律实践之间的关键环节;劳动法则为技术应用和组织运行划定规范边界,确认并调整组织内部权利义务关系,并通过法律解释与制度续造保持对技术发展的适应性。第三章运用上述视角,分析数智时代劳动法面临的具体问题。算法在劳动管理与决策中日益重要,数据成为生产过程评价的基本要素,自动化设备开始替代部分人力。平台借助数字技术连接劳动力与工作任务,用工规模与工时安排更趋灵活,工作过程管理与劳动成果使用在空间上分离。在劳动关系认定上,算法指令削弱人工指挥监督,使人格从属判断困难;收入来源多样化与生产资料提供方式变化,使经济从属适用条件模糊;劳动者组织归属感降低、组织边界模糊,也增加了组织从属判断的难度。在劳动者权益保护上,随时待命的工作方式与碎片化工时冲击工时计算和休息权落实,动态调整的计件单价影响工资支付确定性,数字监控的合理范围仍待明确。在劳动关系协调中,平台企业、外包主体、合作机构和个人劳动者等多方主体并存,使协商主体识别、信息披露和责任分配更加复杂;算法规则、数据使用和评价机制成为劳动关系治理的新议题,劳动者地域分散也影响利益表达和沟通协调机制的形成。上述问题的产生,源于技术应用周期短于法律调整周期、技术运作隐蔽性导致监管取证困难,新型用工形态超出传统劳动关系范畴,算法管理下程序性权利与救济途径不足,以及工业时代形成的劳动法概念体系难以涵盖技术介入后的新权利诉求。第四章的理论逻辑是:应在坚持人格尊严与实质公平两项基本价值的基础上,通过技术治理与责任分配的规则设计,实现价值理念的制度化,推动劳动法回应数智技术挑战。数智技术促使用工形态多样化与管理手段技术化,但并未动摇劳动法的价值基础,反而凸显了保护劳动者人格尊严、纠正劳动关系结构性失衡的必要性。劳动者不应被视为技术系统中的数据对象,其工作自主性、人格利益和精神安宁应获得制度保障;法律也应对不同用工形态下的劳动者给予相应保护,防止技术介入加剧既有地位不平等。基于上述价值立场,法律保护方式应随之调整:保护内容从固守特定岗位转向促进劳动者能力持续发展,以应对技术更新带来的职业替代;规范方式应坚守健康、安全、尊严等底线规则,在保持法律刚性的同时为多样化用工形式留出弹性空间,避免法律僵化而脱离实际。规则设计应协调技术工具与人本价值的关系,将劳动法基本要求嵌入技术系统设计,防止技术成为规避义务的工具;同时强化程序透明,保障劳动者了解并质疑影响自身权益的决策过程。在责任归属上,应以实际控制力与收益归属补充形式归责,建立可追溯的责任识别和合理分担机制,确保实际支配劳动过程并从中获益的主体承担相应法律义务。第五章从基础法律关系、个体权利保护、劳动关系协同治理三个方面,提出数智时代劳动法回应新用工形态的规则调整思路。数字技术介入导致劳动过程管理方式与责任分配方式发生结构性变化,劳动法律制度须对此予以回应。在基础法律关系层面,核心是劳动关系认定标准的调整。传统二分法难以涵盖平台用工等新形态,应将数据指标纳入现有认定体系,以算法管理下的关键数据表现作为判断从属性的参考因素。在此基础上,可构建分层分类的保障体系,使保障水平与用工方式相适应。阶梯式失业保险、终身技能账户等制度设计,其功能在于打破“全有或全无”的传统保障模式,在提高制度灵活性的同时保持基本制度的刚性。在个体权利层面,重点是完善算法管理下的程序性权利。针对劳动者对影响自身权益的决策过程缺乏知情与申诉途径的问题,应对算法备案实行分层义务,创建适用于劳动场景的算法审计标准,保障劳动者在算法决定过程中的说明请求、异议表达和人工复核权利。灵活就业人员社会保障、技能发展支持亦需同步跟进。在劳动关系协同治理层面,核心是沟通、协商与责任协调机制的创新。针对用工形态突破单一企业范围、个体劳动者议价能力降低的问题,应确立以实质影响为标准的关联主体信息披露规则,厘清用工链条责任;探索建立跨区域、跨平台的授权代表和行业性沟通机制,以回应平台化、网络化用工趋势;同时,将算法规则制定、数据使用边界、评价机制调整和申诉处理程序纳入制度化沟通框架,形成兼顾效率、秩序与劳动者权益保护的数智劳动关系治理模式。

  • The development of labor law has always been closely linked to technological progress and the evolution of labor organization. Since the Industrial Revolution, technology, labor organization, and labor law have interacted with one another and jointly shaped the development of labor law. With the widespread use of digital technologies and artificial intelligence, technology-driven changes in labor organization have posed new challenges to the existing labor law system. Technological progress has transformed employment patterns and managerial methods, making labor law difficult to apply in certain areas. Partial rule adjustments or expansive interpretations of individual provisions are no longer sufficient to address these structural changes. The key lies in clarifying the relationship among technology, labor organization, and labor law, and promoting systematic adjustments to labor law concepts and institutions.Apart from the introduction and conclusion, this dissertation consists of five chapters.Chapter Ⅰ examines the evolution of labor organization during technological change and the corresponding development of labor law. From the late eighteenth century to the late twentieth century, water and steam power gave rise to the factory system, electricity promoted bureaucratic management, assembly-line technology stabilized large-scale production, and information technology encouraged organizational flattening and decentralized production. Each technological innovation reshaped the labor process, labor relations, and workers’ rights, thereby creating new regulatory needs. From early factory legislation to occupational safety, work-related injury compensation, labor relations coordination, and social security systems, labor protection has continued to expand and the labor law system has gradually improved. Since the late twentieth century, labor law has also begun to regulate non-standard employment relations in a more flexible manner.Chapter Ⅱ analyzes technology, labor organization, and labor law from three dimensions. Drawing on the “technology–institution–organization” framework in public administration, this chapter re-examines their relationship from the perspective of labor law. Technology drives labor changes by altering tools, reshaping information transmission, and introducing new occupational risks. Labor organization serves as the bridge between technology and labor law, as both the site of technological application and the platform on which labor relations unfold. Labor law regulates the rights and obligations arising from technological application and organizational operation, with the protection of workers’ lawful rights and interests as its basic purpose. In this mechanism, technology affects labor organization and legal application; labor organization translates technological change into concrete labor practices; and labor law sets normative boundaries through interpretation and institutional development.Chapter Ⅲ applies this perspective to the challenges faced by labor law in the digital and intelligent era. Algorithms increasingly participate in labor management and decision-making, data have become basic elements for evaluating production processes, and automation has begun to replace certain forms of human labor. Platforms use digital technologies to connect labor with tasks, making employment scale and working-time arrangements more flexible, while separating work-process management from the use of work outcomes. In identifying labor relations, algorithmic instructions weaken traditional human command and supervision, making personal subordination harder to determine; diversified income sources and changing production tools blur economic subordination; and weakened organizational belonging complicates organizational subordination. In protecting workers’ rights, on-call work and fragmented working hours challenge working-time calculation and the right to rest, dynamic piece-rate adjustments affect wage certainty, and the scope of digital monitoring remains unclear. In labor relations governance, multiple participating entities make subject identification, information disclosure, and responsibility allocation more complex, while algorithmic rules, data use, and evaluation mechanisms have become new governance issues.Chapter Ⅳ argues that labor law should respond to digital and intelligent technologies by upholding human dignity and substantive fairness, and by institutionalizing these values through rules on technological governance and responsibility allocation. Digital technologies have diversified employment forms and made management more technology-based, but they have not weakened the value foundation of labor law. Instead, they further highlight the need to protect workers’ dignity and correct structural imbalances in labor relations. Workers should not be reduced to data objects within technological systems; their autonomy, personality interests, and mental well-being should receive institutional protection. Legal protection should shift from merely preserving specific jobs to supporting workers’ continuous capability development. Regulation should uphold bottom-line rules concerning health, safety, and dignity, while allowing appropriate flexibility for diverse forms of employment. The basic requirements of labor law should be embedded into technological systems, procedural transparency should be strengthened, and responsibility should be attributed according to actual control and benefit acquisition.Chapter Ⅴ proposes rule adjustments in three aspects: basic legal relations, individual rights protection, and collaborative governance of labor relations. At the level of basic legal relations, data indicators should be incorporated into the existing framework for identifying labor relations, with key data-based manifestations under algorithmic management serving as reference factors for determining subordination. A tiered and classified protection system may then be established, supported by institutional designs such as graduated unemployment insurance and lifelong skills accounts, so as to move beyond the traditional “all-or-nothing” model. At the level of individual rights, procedural rights under algorithmic management should be improved, including tiered algorithm filing obligations, labor-specific algorithm audit standards, and workers’ rights to explanation, objection, and human review. Social security and skills-development support for flexible workers should also be strengthened. At the level of collaborative governance, mechanisms for communication, consultation, and responsibility coordination should be innovated. Information disclosure should be based on substantive influence, responsibilities along the employment chain should be clarified, and algorithmic rules, data-use boundaries, evaluation mechanisms, and grievance procedures should be incorporated into an institutionalized communication framework, thereby forming a labor relations governance model suited to the digital and intelligent era.
