摘要:

深化纪律检查体制改革、国家监察体制改革,是党的十九大作出的重大部署,推动和健全党和国家监督体系是改革的根本目标。纪检监察体制改革后,纪检机关和监察机关合署办公,纪检监察机关内设机构有了新架构,审查调查程序有了新规范,审查调查措施有了新内容,审查调查工作有了新成效。但受制于体制机制不健全等因素影响,各级纪检监察机关在审查调查中仍存在衔接不畅的情况。 在审查调查过程中,坚持纪在法前,实现纪法贯通、法法衔接是对纪检监察机关和党政机关、司法机关的共同要求。这就要求,我们在实践中,既要树立纪严于法的意识,也要健全纪检监察机关内部纪法衔接机制,还要处理好监察机关与司法机关之间互相配合、互相制约的关系。纪律检查体制改革、国家监察体制改革都是全新的制度设计,纪检监察机关既执纪又执法,如何准确把握纪法关系,如何准确适用“四种形态”,如何做好纪法程序、标准、措施的衔接,最终实现“一加一大于二”的效果,不仅对纪检监察干部的工作能力提出了更高要求,更要求纪检监察机关内部工作流程再造。特别是《监察法》的出台,规定监察机关办案在程序问题上不直接适用《刑事诉讼法》的规定,但在证据问题上要符合《刑事诉讼法》的要求,可以预见,《监察法》与《刑事诉讼法》在现实情况下的衔接必然会遇到一系列新问题。那么,在实际操作中如何协调、如何处理、如何衔接这一系列的问题,确保纪法全面贯通、法法无缝衔接,这是纪检监察机关是否能够高效履行职的关键。在论文中,笔者尝试从以下三个方面进行探讨:一是应该树立怎样的执纪执法理念,厘清纪法关系;二是应该怎样认识及处理纪法衔接中的证据问题;三是监察机关与检察机关对于职务犯罪案件在程序衔接方面应该注意的问题。

  • Deepening the reform of discipline inspection system and national supervision system is an important deployment made by the Nineteenth National Congress of the Party. Promoting and completing the supervision system of the Party and the country is the fundamental goal of the reform. After the reform of the discipline inspection and supervision system, the discipline inspection organs is co-located with supervision organs. A new structure has been set in internal organizations of the discipline inspection and supervision organs, new standards have been established in the examination and investigation procedures, new contents have been added to the examination and investigation measures, and the new effectiveness of the examination and investigation work has been achieved. However, due to the imperfect institutional mechanism and other factors, there is still poor convergence in the investigation of discipline inspection and supervision organs at different levels. In the process of investigation, it is the common requirement of discipline inspection and supervision organs, party and government organizations as well as judicial authorities to adhere to the principle that discipline is prior to law, to realize the consistency of discipline and law and to resolve the contradiction between different laws. Therefore, in practice, we should realise that discipline is stricter than law, complete the cohesive mechanism of discipline and laws within discipline inspection and supervision organs, and coordinate the relationships between supervision organs and judicial organs that are cooperating and restricting each other. Discipline inspection system reform and national supervision system reform are all brand-new system designs. Discipline inspection and supervision organs execute disciplines and enforce laws. How to accurately grasp the relationship between discipline and law, how to precisely apply the "four forms" and how to make a good connection of the disciplinary procedures, standards and measures, to ultimately achieve the effect of "one plus one is greater than two",which requires higher working ability of discipline inspection and supervision cadres and resetting the 2 internal working process of discipline inspection and supervision organs. In particular, the promulgation of the Supervision Law stipulates that supervisory organs shouldn’t directly be appliy the provisions of the Criminal Procedure Law in question of procedure, while the question of evidence should accord with Criminal Procedure Law. It can be predicted that the linking up of the Supervision Law and the Criminal Procedure Law will inevitably cause a series of new problems in the actual situation. How to coordinate, deal with and link up these series of problems in practical operation, to ensure the comprehensive and seamless connection of discipline and law, is the key to whether the discipline inspection and supervision organs can perform their duties efficiently. In this paper, the author tries to discuss following three aspects: firstly, how to establish a proper concept of discipline enforcement to clarify the relationship between discipline and law. Secondly how to recognize and deal with the evidence problem in the connection of discipline and law. Thirdly, the problems that should be paid attention to in the connection of procedure between supervisory organs and procuratorial organs in the case of duty-related crimes.
