随着我国经济的快速发展,公民的财产总量在不断增长。同时,伴随着农 村承包责任制的实行和房地产市场的蓬勃发展,公民拥有的不动产也在迅速增 加,并成为私有财产中最重要和最具保值价值的组成部分。 不动产登记制度是在《中华人民共和国物权法》颁布实施之后设立的,通 过不动产登记可对公民的不动产进行确权和公示。但是,由于种种因素,不动 产登记错误的情况时有发生,给权利人造成财产损失。而且,相应的赔偿责任 性质不明确,导致所适用的救济程序不一致,理论与司法实践存在许多不一致 的做法。本文从赔偿责任性质、归责原则两部分,采用比较分析研究方法,对 比我国目前不动产错误登记赔偿责任制度存在的相关问题,提出不动产错误登 记赔偿责任的解决路径。 全文除引言及结语外,共分三个部分对不动产错误登记赔偿责任进行研究。 第一部分,不动产错误登记的基础理论及立法、司法实践中的问题。这一部分首先简要分析关于不动产登记相关的理论,主要通过总结对比我国的相关立法以及重点分析十二篇案例,旨在发现问题,对我国当前关于不动产错误登记方面做梳理。 第二部分,不动产错误登记赔偿责任的认定。本部分在第一部分的基础上,讨论如何明确不动产错误登记赔偿责任,从比较侵权法的基础,主要归责原则的明确问题,考察了国外的规定,然后探讨我国立法和司法实务中,适用哪种归责原则,进行分析梳理。 第三部分,不动产错误登记赔偿责任的解决路径。本部分针对第一、二部 分提出的问题,分别从立法层面提出完善更高层级的立法,增加关于赔偿责任 性质、归责原则等方面的立法供给,然后从司法层面提出解决的路径。

  • Nowadays, with the rapid development of our country’s economy, the total amount of property of citizens’ has increased continually. Furthermore, with the execution of household responsibility contract system and the expansion of housing market, the degree of privatization of real estate has been greatly improved, and citizens' real estate property has become the most important and valuable part of private property. The real estate registration system was established after the promulgation and implementation of the "Property Law of the PRC " in our country. However, due to various factors, erroneous registrations of real estate often occur. They caused property losses to the parties. Because the development of China's real estate registration system was comparatively late, there are still many differences on the nature and liability of real estate registration. Moreover, the nature of the corresponding liability for compensation is not clear, leading to the application of relief procedures are inconsistent, and there are many inconsistent practices between the theory and judicial practice. This paper adopts comparative analysis and research method from two parts: nature of liability and principle of imputation.By comparing the problems existing in the compensation liability system of real estate error registration in China, this paper puts forward the solutions to the problems. In addition to the introduction and conclusion, the thesis is divided into three parts to study the compensation liability of real estate error registration. The first part is the basic theory of real estate error registration and the problems in legislation and judicial practice. This part firstly briefly analyzes theories related to real estate registration, mainly through summarizing and comparing relevant legislation in China and focusing on the analysis of 12 cases, aiming to find problems and sort out the current wrong registration of real estate in China. The second part is the determination of liability for compensation of real estate error registration. On the basis of the first part, this part discusses how to clarify the liability for compensation of real estate error registration. From the comparison of the basis of tort law and the clear question of the main imputation principle, this part investigates the provisions of foreign countries, and then discusses which imputation principle is applicable in China's legislation and judicial practice to analyze and sort out. The third part is about the solving path to the erroneous registrations. Aiming at the problems raised in the first and second parts, this part proposes to improve the legislation at a higher level from the legislative level, to increase the legislative supply on the nature of compensation liability and the principle of imputation, and then proposes solutions from the judicial level.
