私法视域下商事检察监督法律制度研究

摘要:

在我国现行民商合一立法体制的大背景下,民事监督概念当然包含且必然包含检察机关对于商事案件的监督,而在客观上商事案件之于一般意义上的民事案件具有其自身特殊性,这一点毋庸置疑,而这种特殊性在我国现行民事检察监督制度的基础理论和司法实践中,并未得到足够的认识和重视,商事纠纷直接关系着商事主体的合法权益,关系着国家经济秩序的健康有序发展,及时对商事纠纷的审判、执行、非诉程序等各环节进行监督,有利于防范诉讼风险、预防虚假诉讼、维护司法公正和法治统一,基于此我国应确立商事检察监督制度,充分发挥检察监督维护司法权威、保障审判工作质量的重要作用。 本文首先以我国“民商合一”背景下民事检察监督制度的运行困境为切入点,以此证出我现有的民事检察监督制度并不能满足我国检察机关对于商事案件的监督需求,并从商事行为的特殊性、商法的独立性、商事审判的独立性等视角论述了建立商事区别检察监督制度的应然性与必然性。在充分论证了建立商事检察监督制度的必要性基础上,文章的第二部分开始从宏观层面讨论商事检察监督制度的设计逻辑——与我国现有“四大检察”协同配合,在社会主义市场经济建设领域重点发挥自身作用的检察监督制度。文章的第三部分以前文中商事检察监督制度的基础理论为立足点,进一步阐释了商事检察监督制度的设计理念与设计要求:在监督理念上应贯穿商法精神;在制度架构上应借鉴民事检察监督制度框架并注重设置与商事案件的特有程序相匹配的商事监督程序。文章的最后一部分展现了商事检察监督制度的主要内容及实现路径:首先从商事检察监督制度的总体模式、监督的主要范围和对象来阐述制度基本构成;继而从商事检察监督制度的程序设置及具体监督方式两方面提出监督权的运行构想,并在最后从完善立法、细化分工、强化队伍、加强调研等四个方面提出了作者对于商事检察监督机制外部环境法律完善的几点建议,以期真正实现在检察机关的监督体系中建立商事检察监督制度的构想。

  • In the context of China's current civil and commercial legislation system, the concept of civil supervision certainly includes and must include the supervision of procuratorial organs over commercial cases. Objectively, commercial cases have their own particularity compared with civil cases in the general sense, which is beyond doubt, and this particularity has not been fully recognized and valued in the basic theory and judicial practice of China's current civil procuratorial supervision system, Commercial disputes directly relate to the legitimate rights and interests of commercial subjects and the healthy and orderly development of the national economic order. Timely supervision of the trial, execution, non litigation procedures and other links of commercial disputes is conducive to preventing litigation risks, preventing false litigation, and safeguarding judicial fairness and the unity of the rule of law. Based on this, China should establish a commercial procuratorial supervision system, give full play to procuratorial supervision to safeguard judicial authority An important role in ensuring the quality of judicial work. Firstly, this thesis takes the operation dilemma of the civil procuratorial supervision system under the background of "integration of civil and commercial affairs" in China as the breakthrough point to prove that the existing civil procuratorial supervision system in China can not meet the supervision needs of the procuratorial organs for commercial cases in China, and discusses the necessity and necessity of establishing a commercial differentiated procuratorial supervision system from the perspectives of the particularity of commercial acts, the independence of commercial law, and the independence of commercial trials. On the basis of fully demonstrating the necessity of establishing the commercial procuratorial supervision system, the second part of the article starts to discuss the design logic of the commercial procuratorial supervision system from the macro level - a procuratorial supervision system that cooperates with the existing "four procuratorates" in China and plays its own role in the field of socialist market economy construction. The third part of the article, based on the basic theory of the commercial procuratorial supervision system in the previous article, further explains the design concept and design requirements of the commercial procuratorial supervision system: the spirit of commercial law should be penetrated in the supervision concept; In the institutional framework, we should learn from the framework of the civil procuratorialsupervision system and pay attention to the establishment of commercial supervision procedures that match the special procedures of commercial cases. The last part of the article shows the main content and realization path of the commercial procuratorial supervision system: first, it expounds the basic composition of the system from the overall mode, main scope and object of the commercial procuratorial supervision system;Then it puts forward the concept of the operation of the supervision power from the two aspects of the procedure setting and the specific supervision mode of the commercial procuratorial supervision system. Finally, it puts forward the author's suggestions on the improvement of the external environment law of the commercial procuratorial supervision mechanism from four aspects of improving legislation, refining the division of labor, strengthening the team, and strengthening research, so as to truly realize the concept of establishing the commercial procuratorial supervision system in the supervision system of procuratorial organs.
