《大清新刑律》是清末修律的重要成果之一，对此进行深入全面的研究，有利于对清末刑律改革进行整体性的把握，有利于更加透彻地了解清末刑律改革的完整性，同时也能更清楚地掌握中华法系在中国近代的最后演变过程。加强对《大清新刑律》的研究还可以同时对《大清律例》、《大清现行刑律》的研究有机地联系起来，总结历史经验，通过借鉴刑法近代化过程中的经验和教训，探寻中国刑事法律国际化和本土化的道路，为当代中国法律改革提供借鉴，为创造和谐社会和法制社会提供理论支持。本文第一章主要阐述了《大清新刑律》制定的背景和过程；第二章阐述了《大清新刑律》的主要内容，重点介绍了《大清新刑律》在体例上的变化、法条的增删、接受修订旧律的成果以及刑制的变化等；第三章阐述了《大清新刑律》与近代刑法的基本原则。第四章阐述了《大清新刑律》影响及对当代中国刑法的启示。

  • The New Criminal Code of Qing Dynasty is one of the important achievements of law amendments in the late Qing dynasty, thus the deep and comprehensive research on the Code is conducive to the overall grasp of the criminal law reform in the late Qing dynasty, to the thorough understanding on the completeness of the criminal law reform therein and to the clear grasp of the ultimate evolution of the Chinese legal system in the modern times. The research thereon is also conducive to the organic connection with the research on the Laws and Regulations of the Qing Dynasty and the Penal code of the Qing Dynasty, and by summarizing historical experience and referring to experience and lessons in the modernization of the criminal law, to exploring the path to internationalization and localization of the Chinese criminal law to offering reference for the Chinese legal reform and the theoretical support for the creation of the harmonious society and legal society. In this paper, Chapter One mainly elaborates the background and the process of the formulation of the New Criminal Code of Qing Dynasty; Chapter Two elaborates the main contents thereof, focusing on the change in the layout, addition and deletion of the clauses of the New Criminal Code of Qing Dynasty, the achievements from the amendment to the old criminal law and the change in the criminal system; Chapter Three elaborates the basic principles of the New Criminal Code of Qing Dynasty and the criminal law in the modern times; and Chapter Four elaborates the influence of the New Criminal Code of Qing Dynasty and its enlightenment to the criminal law of modern China.
