摘要:

非强制性执法是借鉴行政法非强制性执法的概念发展而来的。行政法意义上 的非强制性执法,是指行政活动中针对相对人所实施的不带命令性或强制性的行 为。经济法非强制性执法作为新兴的执法方式,在我国实践中面临相对尴尬的境 地,一方面我国经济法律制度仍在逐步完善中,比如反垄断法的实施不过五年, 相比西方发达国家我国经济法还没有完全进入“后立法”时代。这种背景下,严 格依照法律执法的呼声在法学界的声音仍然很强烈,经济法非强制性执法的质疑 声扔大范围的存在。另一方面,我国市场经济发展已经相对成熟,目前已经进入 深化发展的阶段。得益于市场经济的发展,我国经济总量也高居世界第二位,仅 次于美国。而这种经济成果的取得离不开经济法执法方面的支撑,其中实践中非 强制性执法的应用已经蔚然成风。因此,必须正视非强制性执法方式的存在,前 瞻性地将其制度化、法治化,以期发挥出调整市场经济的功能。本文除引言外, 分为三个部分: 引言,阐明了本文的选题背景、研究综述、研究目的与研究意义等。 第一部分,经济法执法方式概述。针对传统经济法执法方式存在的问题,在 反思的基础上,提出了经济法应引入非强制性执法方式。进而从经济法非强制性 执法的学理认知着手,探析其本源,先后分析经济法非强制性执法的内涵、特征 和表现形式。最后,从价值的角度,探析经济法非强制性执法的功能。 第二部分,经济法非强制性执法制度的证成,从经济法非强制性执法制度的 理论辨析和实证检视,双向维度证明了经济法非强制性执法存在的基础。商谈理 论、公共治理理论、经济法非强制性干预理论分别从哲学、政治学和经济法学证 明非强制性执法在经济法执法领域适用的可能。随后,将视角转向国内和国外的 实践,分析实践中存在的各种形式的经济法非强制性执法方式。 第三部分,经济法非强制性执法制度的应然之道。该部分主要从规范构成和 动态运行立体的层面,探析了经济法非强制性执法的制度以及法治化的要求。经 济法非强制执法制度的目标定位为制度失范矫正的法治化运作机制、权力和权利 互相尊重的协作机制、经济秩序维护的实效性运作机制。经济法非强制执法制度 应该由执法权、适用范围、执法程序构成,同时运行上程序的实施和结果的监督 都应纳入法治化之中。

  • Non-mandatory administrative law enforcement is the concept of drawing non-mandatory enforcement evolved. Non-mandatory administrative law enforcement sense, refers to the act without command or compulsory administrative activities for the counterpart implemented. Law enforcement as a new non-mandatory enforcement approach, facing a relatively awkward position in our practice, one of China's economy is still in the gradual improvement of the legal system, such as the implementation of anti-monopoly law, but five years, compared to the developed countries of the West Law has not fully entered the "post-legislation" era. Against this background, in strict accordance with the voice of law enforcement in the legal community is still very strong voice, Law Enforcement non-mandatory target of criticism there is a large range of throw. On the other hand, China's economic development has been relatively mature market, has now entered a stage of deepening development. Thanks to the development of market economy, China's economic aggregate has ranked second in the world, after the United States. The first part :the transformation of the economic law enforcement approach outlined. Law enforcement approach for traditional problems on the basis of reflection on the proposed Law enforcement should introduce non-mandatory way. Then from the Law Enforcement non-mandatory theoretical knowledge to proceed, its origin, has analyzed the economic law of non-enforcement of mandatory content, features and manifestations. Law enforcement system should be composed of non-mandatory by law enforcement powers, the scope of law enforcement procedures, and implementing and monitoring the results of running the program should be included among the rule of law.
