诉源治理是对我国传统“和合”“无讼”文化的继承与发扬,是对人民群众解纷需 求的积极回应,是国家治理能力和治理体系现代化的重要组成部分。加强和创新诉源治 理是全党全社会的责任,是党委政府、各职能部门以及人民法院的分内之事、应尽之责。 推动诉源治理工作,应当在加强人民法院建设的同时,探索构建完备的纠纷预防和化解 法律体系,系统性降低矛盾纠纷产生以及发展为诉讼的概率;探索转变“未病”阶段治 理模式,着力增强社会免疫力和稳定性,切实提升风险预防、摸排感知能力;探索建立 全流程矛盾纠纷化解机制,坚持以防为基、以调为主、诉讼断后,真正让更多资源向引 导和疏导端用力;探索完善闭环管理机制,促进治理成果共评共享,全链条压实诉源治 理责任;探索建设高水平整体智治平台,打通数据壁垒,建好智治中枢,提高智治效能; 探索完善保障体系,优化考核体系,加强队伍培养、科技赋能和财力保障。

  • The governance of litigation sources represents the inheritance and promotion of China's traditional culture of "harmony" and "non-litigation." It is a proactive response to the dispute resolution needs of the people and an integral part of modernizing the country's governance capacity and system. Strengthening and innovating the governance of litigation sources is the responsibility of the entire Party and society, as well as Party committees, governments, and functional departments. To promote the governance of litigation sources, we should strengthen the construction of people's courts , and We should explore and promote the establishment of a comprehensive legal system for dispute prevention and resolution, systematically reducing the occurrence of conflicts and disputes and minimizing the probability of them escalating into litigation. Efforts should be made to transform the governance model during the "pre-disease" stage, with a focus on enhancing social immunity and stability, improving risk prevention capabilities, and effectively enhancing the ability to anticipate and perceive risks. Additionally, exploring the establishment of a mechanism for resolving conflicts and disputes throughout the entire process, embracing prevention as the foundation, mediation as the primary approach, and litigation as a last resort, will ensure that more resources are directed towards guidance and diversion. The implementation of a closed-loop management mechanism should be explored to facilitate shared evaluation and sharing of governance outcomes, and to firmly establish the responsibility of litigation source governance throughout the entire chain. Furthermore, efforts should be made to build a high-level integrated intelligent governance platform, breaking down data barriers, establishing a robust intelligent governance center, and improving the effectiveness of intelligent governance. The improvement of support systems, optimization of assessment systems, and the strengthening of team training, technological empowerment, and financial support should also be explored.
