摘要:

随着农村土地“三权分置”改革被立法固化,农村土地经营权流转得到快速推进,但农村土地经营权流转中农民权益保护问题也有所突显。《农村土地承包法》协同推动农村土地经营权流转与农民权益保护,在很大程度上盘活了农村土地要素的适度市场化利用,利于增加农民财产权益,维护农村社会稳定,极大促进了全面实施乡村振兴战略。但 2018 年修改《农村土地承包法》时,立法者对农村土地经营权流转实践中存在的争议问题采取了暂不作规定的做法,为后续探索留下空间。这一思路也成为制约农村土地经营权流转中农民权益保护的重要原因。学界相关探讨的重点相对集中在农村土地经营权流转法律制度、农村土地经营权流转方式、农村土地经营权流转监管等方面,甚少以《农村土地承包法》修改后的农村土地经营权流转实践为背景讨论农民权益保护问题。在此背景下,探索农村土地经营权流转中农民权益保护,不仅利于保护农民权益,促进乡村振兴,也为进一步完善《农村土地承包法》提供了重要的视角和参考。 除绪论、结论与展望外,主要内容分为四个部分: 第一部分从理论上界定农村土地经营权流转中农民权益,分析农村土地经营权流转中侵害农民权益的行为。按照先后界定农村土地经营权、农村土地经营权流转、农村土地经营权流转中农民权益的思路,将农村土地经营权流转中农民权益界定为:农民在保留土地承包权的前提下,通过出租等流转方式流转农村土地经营权所应获得法律保护的土地承包权及其他相关权益。将农村土地经营权流转中农民权益的特征归结为主体的特定性、实体权利与程序权利的兼容性、内容的复杂性等。基于农民权益的实体性、价值性和流动性,将农村土地经营权流转中农民权益分解为实体性权益和程序性权益。从政府、集体、受让方三类主体角度归纳分析农村土地经营权流转中侵害农民权益的典型行为。 第二部分梳理农村土地经营权流转中农民权益保护的现状。结合立法依据梳理农村土地经营权流转中农民权益确权保护现状,将农村土地经营权流转中农民实体性权益确定为农村土地经营权、农村土地经营权流转权、农村土地经营权流转收益权、流转后农村土地经营权收回权、救济权;将程序性权益保护确定为流转知情权、流转中的优先权、1 监督权等。进而,从规定必备条款、出台示范流转合同、合同备案登记等方面归纳出流转合同的规范实际,从政府保护和司法保护两方面梳理出农村土地经营权流转中农民权益保护的相关方案。 第三部分分析农村土地经营权流转中农民权益保护存在的问题。在保护的依据方面,相关立法尚存在一定的缺失或冲突。在确权方面,没有面向农村土地经营权流转中的不同主体类型,在农村土地经营权的确权保护认知、资金支持、登记管理、价值评估等方面也存在欠缺。实体性权益保护面临农村土地经营权自主流转缺乏一套完善的法律制度、收益权保护缺失、农村土地经营权流转中经营权的收回权尚未完善、救济权不到位等问题,程序性权益保护存在农民经营自主权得不到保护、流转监督权较弱等问题。同时,还面临效力认定无效化和不规范、流转登记簿和权属证书不一致、流转中农民权益的政府保护不力、司法保护受案范围和保护途径较窄等问题。 第四部分提出农村土地经营权流转中农民权益保护的优化举措。一是完善农村土地经营权流转中农民权益保护依据,规避农村土地经营权流转中农民权益保护相关依据之间的冲突。二是加强农村土地经营权的确权保护,从增强意识、资金支持、规范确权登记及价值评估等方面,依法确认和保障农民的土地物权。三是从实体性权益、程序性权益保护的层面,切实保护农村土地经营权流转中的农民权益。四是规范农村土地经营权流转合同,完善农村土地经营权流转合同效力规则,规范农村土地经营权流转合同登记工作和农村土地经营权流转登记簿及其权属证书,保证流转登记簿和权属证书的一致性,探索构建农村土地经营权流转价格协商机制。五是加强政府保护,控制“越位”,纠正“错位”,填补“缺位”。六是拓宽农村土地经营权流转农民权益司法保护途径,建议在法院受案范围上应结合实际开展案件受理工作。

  • With the legislative solidification of the "separation of three rights" reform in rural land, the transfer of rural land management rights has been rapidly promoted. However, the issue of protecting the rights and interests of farmers in the transfer of rural land management rights has also become prominent. The Rural Land Contracting Law synergistically promotes the transfer of rural land management rights and the protection of farmers' rights and interests, greatly revitalizing the moderate market-oriented use of rural land elements, increasing farmers' property rights and interests, maintaining rural social stability, and greatly promoting the comprehensive implementation of the rural revitalization strategy. However, when revising the Rural Land Contracting Law in 2018, legislators temporarily left no provisions on the controversial issues in the practice of rural land management rights transfer, leaving room for further exploration. This approach has also become an important reason for restricting the protection of the rights and interests of farmers in the transfer of rural land management rights. The focus of academic discussions is relatively concentrated on the legal system of rural land management rights transfer, the methods of rural land management rights transfer, and the supervision of rural land management rights transfer. There is little discussion on the protection of rural rights and interests based on the practice of rural land management rights transfer after the amendment of the Rural Land Contracting Law. In this context, exploring the protection of farmers' rights and interests in the transfer of rural land management rights not only benefits the protection of farmers' rights and promotes rural revitalization, but also provides an important perspective and reference for further improving the Rural Land Contracting Law. In addition to the introduction, conclusion, and outlook, the main content is divided into four parts: The first part theoretically defines the rights and interests of farmers in the transfer of rural land management rights, and analyzes the behaviors that infringe upon the rights and interests of farmers in the transfer of rural land management rights. According to the concept of defining rural land management rights, rural land management rights transfer, and farmers' rights and interests in rural land management rights transfer, the rights and interests of farmers in rural land management rights transfer are defined as the land contracting rights and other3 related rights that farmers should obtain legal protection for when transferring rural land management rights through leasing and other transfer methods, while retaining the land contracting rights. The characteristics of the rights and interests of farmers in the transfer of rural land management rights can be attributed to the specificity of the subject, the compatibility of substantive and procedural rights, and the complexity of the content. Based on the entity, value, and liquidity of farmers' rights, the rights of farmers in the transfer of rural land management rights are decomposed into entity rights and procedural rights. Summarize and analyze typical behaviors that infringe on the rights and interests of farmers in the transfer of rural land management rights from the perspectives of the government, collectives, and transferee. The second part outlines the current situation of protecting the rights and interests of farmers in the transfer of rural land management rights. Based on legislative basis, the current situation of protecting the rights and interests of farmers in the transfer of rural land management rights is sorted out, and the substantive rights and interests of farmers in the transfer of rural land management rights are determined as rural land management rights, rural land management rights transfer rights, rural land management rights transfer income rights, post transfer rural land management rights recovery rights, and relief rights; Determine the protection of procedural rights as the right to know about the circulation, priority in the circulation, and supervision. Furthermore, from the aspects of stipulating necessary clauses, issuing demonstration transfer contracts, and contract filing and registration, the normative reality of transfer contracts is summarized. From the perspectives of government protection and judicial protection, relevant plans for protecting the rights and interests of farmers in the transfer of rural land management rights are sorted out. The third part analyzes the problems of protecting the rights and interests of farmers in the transfer of rural land management rights. In terms of the basis for protection, there are still certain deficiencies or conflicts in relevant legislation. In terms of property rights confirmation, there is no targeting of different types of subjects in the transfer of rural land management rights, and there are also deficiencies in the recognition of property rights protection, financial support, registration management, and value evaluation of rural land management rights. The protection of substantive rights and interests faces problems such as the lack of a complete legal system for the transformation of rural land management rights from mainstream to mainstream, the lack of protection for income rights, the incomplete right4 to recover management rights in the transfer of rural land management rights, and inadequate relief rights. Procedural rights and interests protection also faces problems such as the lack of protection for farmers' autonomy in management and weak supervision rights in the transfer. At the same time, it also faces problems such as ineffective and irregular determination of effectiveness, inconsistency between transfer registration books and ownership certificates, inadequate government protection of farmers' rights and interests in transfer, and narrow scope and channels of judicial protection. The fourth part proposes optimization measures for protecting the rights and interests of farmers in the transfer of rural land management rights. One is to improve the basis for protecting the rights and interests of farmers in the transfer of rural land management rights, and avoid conflicts between the relevant basis for protecting the rights and interests of farmers in the transfer of rural land management rights. The second is to strengthen the protection of rural land management rights by enhancing awareness, financial support, standardizing registration and value evaluation, and legally confirming and safeguarding the land rights of farmers. Thirdly, from the perspective of protecting substantive and procedural rights, effectively protect the rights and interests of farmers in the transfer of rural land management rights. The fourth is to standardize the transfer contracts of rural land management rights, improve the effectiveness rules of rural land management rights transfer contracts, standardize the registration work of rural land management rights transfer contracts, rural land management rights transfer registration books and their ownership certificates, ensure the consistency of transfer registration books and ownership certificates, and explore the construction of a price negotiation mechanism for rural land management rights transfer. The fifth is to strengthen government protection, control "offside", correct "misalignment", and fill "gaps". Six is to broaden the judicial protection channels for the rights and interests of farmers in the transfer of rural land management rights. It is suggested that the scope of court cases should be combined with the actual situation to carry out case acceptance work.
