摘要:

执法安全合作是国际合作在执法领域的延伸,也是跨国安全治理的重要组成部分,是两个或者多个国家通过合作执法的方式对具有跨国影响的安全威胁进行治理的重要手段。澜沧江-湄公河区域是中国与周边国家开展执法安全合作的重要区域。近年来,中国与缅甸、老挝、泰国、柬埔寨、越南五国广泛开展多边或者双边执法安全合作,并在澜沧江—湄公河合作机制框架下建立了澜沧江—湄公河区域执法安全合作机制,该机制建立以来已初步取得一定成效。 随着大国在澜沧江—湄公河区域博弈日趋激烈,特别是 2020 年以来,世界百年未有之大变局和百年疫情同频共振形成复杂的国际局面,区域各国在政治、经济、社会、文化等方面发生着重大变化,澜沧江—湄公河区域地区安全形势出现了一些新特点。一方面传统犯罪因素如毒品犯罪、人口走私犯罪等风险依然猖獗;另一方面“颜色革命”、恐怖主义犯罪日趋成为新的潜在威胁;同时,中国人在缅甸北部和柬埔寨等地区从事电信诈骗犯罪和有组织犯罪问题高发给区域各国造成了严重危害。随着中老铁路建成通车,中泰铁路、中老柬铁路等“一带一路”互联互通项目的推进,以及中国倡导,澜沧江—湄公河六国共同主导的澜沧江—湄公河合作机制合作成果的日益显现,澜沧江—湄公河区域各国之间的联系将更加密切,但随之也带来了更大的安全风险,亟需要适应现实需要,进一步充实法治内涵,优化完善相关机制,探索创新执法安全合作新路径,就如何有效维护澜沧江—湄公河区域安全稳定发展而言,建立统一、规范、法治化、可操作的执法安全合作机制显得尤为重要。 本文在参考中外文献的基础上,以澜沧江—湄公河区域执法安全合作机制研究为题,从澜沧江—湄公河区域执法安全合作机制的基础理论入手,简要阐述了澜沧江—湄公河区域执法安全合作机制的相关概念、法律依据和基本原则,深入分析了澜沧江—湄公河区域执法安全合作机制的发展因应,以及构建澜沧江—湄公河区域执法安全合作机制的必要性,详细梳理了现行澜沧江—湄公河区域执法安全合作机制的运行现状和现实困境,进而提出了优化完善并创新澜沧江—湄公河区域执法安全合作机制的方法路径。本文共五章。其中,第一章“澜沧江—湄公河区域执法安全合作机制的基础理论”,简要阐述了澜沧江—湄公河区域执法安全合作机制的相关概念界定、法律依据和基本原2 则,并对区域主义与国际关系、地区公共产品、国际安全合作等相关理论在澜沧江—湄公河区域执法安全合作机制中的应用进行了分析归纳,这是本文进行研究的理论基础。第二章“澜沧江—湄公河区域执法安全合作机制的发展因应”,从澜沧江—湄公河区域执法安全合作的背景入手,回顾了执法安全合作的历史演进,阐述了完善澜沧江—湄公河区域执法安全合作机制是应对区域安全威胁的迫切需求和区域合作发展的必然要求。强调各国需要在尊重彼此主权和核心利益的基础上,加强对话与沟通,建立更加完善的合作机制和法律框架,以确保执法安全合作的有效开展和持续推进。 第三章“澜沧江—湄公河区域执法安全合作机制的运行现状”,主要介绍了当前澜沧江—湄公河区域各国合作效果较好的几个执法安全合作机制,如:高层会议机制、联合巡逻执法机制和澜沧江—湄公河综合执法安全合作中心,对其基本情况以及取得的初步成效进行了分析评价,以期为优化完善创新澜沧江—湄公河区域执法安全合作机制提供实践范式。 第四章“澜沧江—湄公河区域执法安全合作机制面临的现实困境”,从法治困境、合作困境、发展困境三个维度,侧重对当前澜沧江—湄公河区域执法安全合作机制建设面临的挑战和问题进行梳理归纳,以问题导向为切口,明确澜沧江—湄公河区域执法安全合作机制优化完善的研究方向。通过梳理澜沧江—湄公河区域国家开展执法安全合作的国际公约及双边、多边条约和相关法律文件,归纳出目前澜沧江—湄公河区域执法安全合作机制在法律依据层面存在不足,缺乏充分的、具有强制力的执法合作依据,极大地限制了各国开展预防犯罪、侦破跨国犯罪、惩治罪犯等领域合作的进一步发展。基于现有合作机制存在功能重叠、规则冲突、程序复杂及部分国家参与度较低的现状,很多较为成熟的合作机制仍无法充分发挥其作用,加大了执法安全合作的成本,对凝聚区域共同体发展的共识也产生不利影响。同时,在世界各国面临许多共同挑战的同时,域外大国介入澜沧江—湄公河区域,试图干涉澜沧江—湄公河区域共同发展,操控国际政治经济格局,加之国际环境的变化,给澜沧江—湄公河区域的发展带来了一定冲击,完善区域安全合作机制的需求更加迫切。 第五章“澜沧江—湄公河区域执法安全合作机制的优化策略”,针对当前澜沧江—湄公河执法安全合作机制建设和推进中存在的困境与问题,从澜沧江—湄公河区域执法安全合作机制条约化、协调化、效率化以及实现人类命运共同体在合作机制中的价值嵌入等方面提出优化完善并创新澜沧江—湄公河区域执法安全合作机制的构想。建议澜沧3 江—湄公河区域各国要增强区域各国政治互信,整合现有澜沧江—湄公河合作框架下的执法安全合作机制,签署具有强制约束力的多边区域执法安全合作条约。同时,借助新兴科技手段创新合作平台建设,并充分发挥澜沧江—湄公河综合执法安全合作中心的综合执法平台功能,加强区域各国间各领域的深度合作,为澜沧江—湄公河区域进一步发展繁荣提供更好的安全和法治保障。 当前,澜沧江—湄公河区域各国在构建人类命运共同体理念的引领下,认真践行全球发展倡议、全球安全倡议、全球文明倡议,秉持“发展为先、平等协商、务实高效、开放包容”的澜湄精神,积极推动构建澜湄国家命运共同体。基于现有的研究成果和本文的分析研究,我们可以清晰地看到,澜沧江—湄公河区域作为一个多元且复杂的地理政治单元,面对经济全球化和科学技术迅猛发展的态势,其执法安全合作既面临着前所未有的机遇,也存在着诸多挑战。澜沧江—湄公河区域国家应当共同肩负起新形势下的区域执法安全合作使命,共同促进执法安全合作机制的完善,构筑可持续发展的合作纽带和安全稳定的政治环境,不断推进区域一体化建设,为落实联合国 2030 年可持续发展议程作出贡献,为全球安全治理提供澜湄经验,澜湄范式。

  • Law enforcement and security cooperation represent an extension of international collaboration in the realm of law enforcement and a vital component of cross-border security governance. It serves as a vital means for two or more countries to address cross-border security threats through cooperative law enforcement. The Lancang-Mekong region is an important area where China and its neighboring countries engage in law enforcement and security cooperation. In recent years, China has extensively carried out multilateral and bilateral law enforcement and security cooperation with Myanmar, Laos, Thailand, Cambodia, and Vietnam. Under the framework of the Lancang-Mekong Cooperation (LMC) mechanism, a law enforcement and security cooperation mechanism for the Lancang-Mekong region has been established, yielding initial achievements since its inception. As great powers intensify their strategic competition in the Lancang-Mekong region, especially since 2020, the convergence of unprecedented global changes and the ongoing pandemic over the past century has created a complex international landscape. Significant transformations in politics, economics, society, and culture in the region’s nations have led to new characteristics in the regional security situation. On one hand, while traditional criminal risks such as drug trafficking and human smuggling remain rampant have emerged. On the other hand, issues like “color revolutions” and terrorism have increasingly become potential threats. Additionally, the rise in organized crimes such as telecommunications fraud involving Chinese nationals in northern Myanmar and Cambodia has posed serious challenges to the region. With the completion and operation of the China-Laos Railway and the advancement of connectivity projects under the Belt and Road Initiative, such as the China-Thailand Railway and the China-Laos-Cambodia Railway, along with the increasing manifestation of cooperation outcomes from the Lancang-Mekong Cooperation mechanism, which is jointly led by the six Lancang-Mekong countries under China’s initiative, the connections among countries in the Lancang-Mekong region has become closer. However, this also brings greater security risks, necessitating the adaptation to current needs by further enriching the legal connotation, optimizing and improving relevant mechanisms, and exploring innovative paths for law enforcement and security cooperation. To effectively maintain stability and foster development in the Lancang-Mekong region, establishing a unified, standardized, legally5 grounded, and operable law enforcement and security cooperation mechanism is of utmostimportance. Based on a review of both domestic and foreign literature, this paper focuses on theresearch of law enforcement and security cooperation mechanisms in the Lancang-Mekongregion. It begins with an exploration of the basic theory underlying this mechanism, providinga brief overview of its relevant theories, legal basis, and fundamental principles. The paperthen delves into the development response of the mechanism and the necessity for itsestablishment. Furthermore, it thoroughly reviews the current operational status and practicaldifficulties faced by the Lancang-Mekong law enforcement and security cooperationmechanism, ultimately proposing methods and pathways for its optimization and innovation. This paper consists of five chapters. Chapter One, titled “The Basic Theory of the LawEnforcement and Security Cooperation Mechanism in the Lancang-Mekong Region”, brieflydefines a concise overview of the key concepts, legal foundations, and fundamental principlesrelated to this mechanism. It also analyzes the application of relevant theories such asregionalism, international relations, public goods, and international security cooperationwithin the context of the Lancang-Mekong law enforcement and security cooperationmechanism, serving as the theoretical foundation for the research. Chapter Two, titled “The Development Response of the Law Enforcement and SecurityCooperation Mechanism in the Lancang-Mekong Region”, begins with the background of lawenforcement and security cooperation in the Lancang-Mekong region. It reviews the historicalevolution of this cooperation, elaborating on the urgent need to enhance the Lancang-Mekonglaw enforcement and security cooperation mechanism in response to regional security threatsand the inevitable requirement for regional cooperation and development. The chapteremphasizes the importance for countries to strengthen dialogue and communication on thebasis of respecting each other ’ s sovereignty and core interests, and to establish a morecomprehensive cooperation mechanism and legal framework to ensure the effectiveimplementation and sustainable advancement of law enforcement and security cooperation. Chapter Three, titled “ The Current Status of the Law Enforcement and SecurityCooperation Mechanism in the Lancang-Mekong Region ” , primarily introduces severaleffective law enforcement cooperation mechanisms currently in place among the countries inthe Lancang-Mekong region, including the high-level meeting mechanism, joint patrol law6 enforcement mechanism, and the Lancang-Mekong Comprehensive Law Enforcement and Security Cooperation Center. The chapter analyzes and evaluates the basic conditions and initial achievements of these mechanisms, aiming to provide practical examples for optimizing and innovating the Lancang-Mekong law enforcement and security cooperation mechanism. Chapter Four, titled “ Realistic Dilemmas of the Law Enforcement and Security Cooperation Mechanism in the Lancang-Mekong Region”, analyzes the realistic dilemmas of cooperation mechanism from the perspectives of law, cooperation, and development, focuses on sorting out and summarizing the challenges and issues faced by the current construction of the Lancang-Mekong regional law enforcement and security cooperation mechanism. By adopting a problem-oriented approach, it clarifies the direction for optimizing and improving the mechanism. Through an examination of international conventions, bilateral and multilateral treaties, and relevant legal documents among Lancang-Mekong countries, the chapter highlights the legal deficiencies within the existing cooperation framework. It notes that there is a lack of robust, binding legal foundations for law enforcement cooperation, which significantly hampers progress in areas such as crime prevention, transnational crime investigation, and criminal prosecution. Additionally, the chapter points out that given the current situation of overlapping functions, rule conflicts, complex procedures, and low participation from some countries within existing cooperation mechanisms, many relatively mature mechanisms fail to fully play their roles, increasing the cost of law enforcement and security cooperation and adversely affecting the consensus for regional community development. Meanwhile, as countries worldwide face numerous common challenges, the intervention of extra-regional powers in the Lancang-Mekong region, attempting to interfere with its joint development and manipulate the international political and economic landscape, coupled with changes in the international environment, has brought certain impacts on the region's development, making the improvement of regional security cooperation mechanisms more urgent. Chapter Five, titled “Optimization Strategies for the Law Enforcement and Security Cooperation Mechanism in the Lancang-Mekong Region”, addresses the current challenges and issues in the construction and promotion of the Lancang-Mekong law enforcement and security cooperation mechanism. It proposes a conception to optimize, improve, and innovate the law enforcement and security cooperation mechanism in the Lancang-Mekong region,7 focusing on the treaty-based, coordinated, and efficient cooperation, as well as the embedding of the value of a community with a shared future for mankind within the cooperation mechanism. The chapter suggests that Lancang-Mekong countries should enhance political mutual trust, integrate the existing law enforcement and security cooperation mechanism under the Lancang-Mekong cooperation framework, and sign multilateral regional law enforcement and security cooperation treaties with binding force. Additionally, it advocates for leveraging emerging technological means to innovate cooperation platform development and maximizing the capabilities of the Lancang-Mekong Comprehensive Law Enforcement and Security Cooperation Center. This would foster deeper cooperation across various fields among regional countries, ultimately providing better security and legal assurances for the region’s continued development and prosperity. Currently, guided by the vision of building a community with a shared future for mankind, Lancang-Mekong countries are earnestly implementing the Global Development Initiative, the Global Security Initiative, and the Global Civilization Initiative, adhering to the Lancang-Mekong commitment to“development first, equal consultation, practical efficiency, and openness”, aiming to promote the construction of a community of shared destiny among Lancang-Mekong nations. Based on existing research findings and the analysis presented in this paper, it is clear that as a diverse and complex geopolitical unit facing the trends of economic globalization and rapid scientific and technological development, the Lancang-Mekong region faces both unprecedented opportunities and many challenges in law enforcement and security cooperation. The countries of the region should jointly shoulder the mission of enhancing regional law enforcement and security cooperation under the new situation. Together, they should promote the improvement of cooperation mechanisms, establish sustainable partnerships, and foster a secure and stable political environment. This will further advance regional integration, contribute to the implementation of the United Nations 2030 Agenda for Sustainable Development, and offer the Lancang-Mekong experience and model for global security governance.
