摘要:

政务信息公开制度是指国家行政机关和法律、法规以及规章授权和委托的组织,在行使国家行政管理职权过程中 ,通过法定形式和程序,主动将政务信息向社会公众或依申请而向特定的个人或组织公开的制度。注重政务信息公开制度建设是20世纪以来行政法发展的重要趋势。建立和完善政务信息公开制度,对保障知情权的实现,发展我国社会主义民主政治、预防和惩治腐败,提高行政效率,促进经济发展和构建和谐社会具有重要意义。改革开放以来,我国在政务信息公开制度建设方面积极探索,取得了一些成绩,但仍存在诸多亟待解决的问题。因此,对如何建立和完善我国政务信息公开制度进行研究,具有重要的理论意义和现实意义。本文首先对政务信息公开的基本理论进行了阐述,然后采用比较研究方法,探讨政务信息公开制度的共性,总结外国好的经验和做法,根据我国政务信息公开制度建设的现状,指出了需要研究解决的突出问题。在上述分析研究的基础上,从政务信息公开的立法思路、公开的范围和程序、救济制度、监督和保障措施等方面,就如何建立和完善我国政务信息公开制度提出了自己的看法和建议。 本文分为四章。第一章是政务信息公开制度的基本概述,论述了政务信息公开的概念及特征、主体、客体、方式和载体。 第二章是政务信息公开的理论基础。论述了政务信息公开与人民主权理论、知情权理论、公众参与理论和和谐社会理论的关系。 第三章是政务信息公开制度的比较分析。采取比较分析的方法,论述了国外政务信息公开制度的立法路径、公开范围、公开程序、救济制度及监督保障措施等内容,探讨了政务信息公开的共性,主要有 :政务信息公开立法路径呈现出地方推动中央立法、政党竞选推动立法、非政府组织推动立法等突出特点;坚持“以公开为原则,不公开为例外”的原则,对例外信息采用列举方式明确规定,对特别例外信息作特殊处理;程序方面一般包括行政机关主动公开信息和依申请公开信息两种;在救济设置上,注重行政复议机构的独立性、专业性建设,充分重视对第三人合法权益的保障,对是否属于例外信息的审查采取不公开单方审理方式,普遍采取穷尽行政内救济原则和司法最终救济原则等。本章还对国外好的经验进行了总结。第四章是对我国政务信息公开法制化的建议。对我国政务信息公开的现状、存在的问题进行了归纳,并就推进我国政务信息公开法制化建设在立法思路及具体制度构建方面提出了诸多切实可行的建议,主要包括:我国政务信息公开的开展状况和立法实践现状;我国政务信息公开存在认识不足、缺乏统一立法、义务主体范围狭窄、客体过于单一、公开渠道散乱、缺少监督机制和救济途径等问题 ;我国应采取先底层级立法,然后再高层级立法,最后制定全国统一的政务信息公开法的思路;提出了符合我国国情的政务信息公开的主体、范围、程序、救济制度、监督和保障措施等具体制度的立法建议。

Therefore, how t establishes and consummates our country government affairs information psystem to conduct the research, has the important theory significance and t practical significance.
