基层政府购买公共法律服务研究一一以C市L区为例

自改革开放以来,我国的公共法律服务体系建设不断推进,经过社会各相关主体的共同努力,我国目前的公共法律服务体系由政府参与主导,社会广泛参与,同时吸引公办民办等力量共同组建而成,形成了我国法治建设的重要组成部分,公共法律服务是维护社会和谐稳定,促进社会公平正义的必然需求。同时,在我国高速发展的当下,社会矛盾也日益增多,对公共服务也提出了较高的专业性需求。这就需要政府充分发挥市场机制的作用,通过一定的方式和程序,将公共法律服务交由符合条件的社会力量来承担。作为建设法治政府、有限政府和服务型政府的重要模式,政府购买公共法律服务在公民法治意识培养、引导群众通过合法途径化解矛盾纠纷中起着重要的作用。 本文从政府购买公共法律服务的相关概念出发,运用新公共管理理论分析了C市L区政府购买公共法律服务的现状以及存在的问题。研究表明:在政府购买公共法律服务中,存在政策不具有长期性、经费保障不足、服务提供主体积极性不强、群众对公共法律服务缺乏信任、公共服务市场化程度不高等一系列问题。 产生这些问题的根源主要在于:政府尚未完成从管理型政府到服务型政府的转变;政府重视度不高;缺乏监督反馈机制;缺少中立第三方组织的独立参与;公共法律服务体系发展不够成熟等等。 针对C市L区政府购买公共法律服务存在的问题和产生根源,本文通过对英美两国和我国杭州市、中山市在政府购买公共法律服务的做法进行对比,有针对性地提出以下建议:一是发挥政府作用,即由政府制定购买服务相关政策,并引导服务市场和服务主体发展;二是建立政府购买公共法律服务机制,即建立政府与服务提供方的契约合作模式,制定服务提供全过程的监督反馈机制;三是激发公共法律服务提供市场活力,即保障预算经费,鼓励社会公益团体参与。

  • In the light of the problems and roots of the government's purchase of public legal servic es in L District of C City, this paper compares the practice of the government's purchase of pu blic legal services in Hangzhou City and Zhongshan City with the way in Britain and the Unit ed States, and puts forward the following suggestions: firstly, to play the role of the governme nt, that means, to formulate policies related to the purchase of services by the government, an d to guide the development of service market and service subjects; secondly, to establish a the mechanism of government purchasing public legal services which means to establish a contractual cooperation model between government and service providers, and to formulate a monitoring and feedback mechanism for the whole process of service provision. The third is to stim ulate the market vitality of public legal service provision, that is, to guarantee budget funds an d encourage the participation of public welfare organizations. Since the reform and opening up, the construction of public legal service system in Chinahas been continuously promoted. Currently, the system has initially formed a public service su pply system with the government-led, social partcipation, public and private sectors. As the im protant part of the legal consrruction, public legal service is necessary requirement of maintai ning social stability and promoting equity and justice. At the same time, with the rapid develop ment in China, the increasing social contradictions bring about higher professional demand fo r public services. It requires the government to give full play to the role of the market mechani sm , through the certain ways and procedures to transfer the public legal services to qualified social forces to undertake. The government purchase of public legal services plays an important role in fostering citizens' belief in the rule of law ; guiding the public to solve conflicts and disputes through legal approach. It is also meaningful to the shaping of modern law-based go vernment, service-oriented government and limited government. Based on the relevant concepts of government purchasing public legal services, this paper uses the theory of new public management and public management to analyze the current situation and existing problems of government purchasing public legal services in L District of C City. And it shows that in the process of government purchasing public legal services, there are a series of problems, such as the lack of long-term policy, insufficient funds guarantee,t he lack of initiative of service providers, the lack of trust of the masses in public legal services, and the low level of marketization of public services. The paper deems that the main causes o f these problems is in that the government has not yet completed the transformation from a ma nagement-oriented government to a service-oriented government, the government attaches litt le importance to it, the lack of supervision and feedback mechanism, the lack of independent participation of neutral third-party organizations, the immature development of the public lega l service system, and so on. Aiming at the problems and causes of C City L District Government's purchasing public legal services, this paper compares the practices of the UK, United States and Hangzhou, Zhon g Shan in government purchase of public legal servicesdefining the orientation of the govern ment, that means, defining the leading role of the government in providing public legal servic es, strengthening the awareness of government services; and establishing government purchas e. Buying public legal service mechanism means establishing the contractual cooperation mode between the government and service providers, formulating detailed contents and evaluation indicators of public service purchasing, formulating coordination and responsibility system a mong departments, formulating supervision and feedback mechanism, and stimulating the ma rket vitality of public legasocial organizationl service provision, that is, guaranteeing budgetary funds and encouraging the participation of public welfare groups.
