国际合作共建跨境直播电商信用机制研究

互联网时代下,全球疫情的爆发催生了跨境直播电商市场的产生与发展,目 前跨境直播电商行业交易规模持续扩大,行业从业人员数量持续增长,整个行业 呈现良好的发展态势。但跨境直播电商发展迅猛的同时也存在着诸多的问题,产 品质量夸大不实、消费数据弄虚作假等行业失信行为频繁发生,行业内存在一定 程度上的信用缺失,极大损害了跨境直播电商消费者的合法权益,阻碍了跨境直 播电商行业的健康发展。随着跨境直播电商行业规模不断扩大,国内外市场联动 频繁,失信事件的发生愈发频繁,跨境失信治理面临的形势愈加严峻,已经引起 了各国政府、国际商会、国际消费者协会等相关机构层面的广泛关注,行业内失 信行为治理刻不容缓,亟待国际合作共建国际跨境直播电商信用约束机制。 直播营销作为跨境电子商务发展的新业态,具有商业模式新、涉及到的境内 外行为主体复杂、法律主体繁多等特点。因此在尝试通过国际合作进行跨境直播 电商行业信用约束机制建立时应当充分考虑到其属性特点、行业发展现状、国内 外监管制度等,以国际商务法律法规为依据明确跨境直播电商活动中相关主体的 法律责任进行约束;结合国际商会对跨境直播电商行业规范的管理办法促进行业 自律;始终接受国际消费者协会监督并保护消费者合法的权益,以此促进跨境直 播电商这一新业态的健康发展。考虑到目前跨境直播电商行业的规模以及现有的 国家间合作构建两国跨境直播电商信用约束机制的实际案例,通过国际合作共建 跨境直播电商信用约束机制不仅必要且具有一定的可行性。 探究跨境直播电商行业失信问题的形成原因,提出国际合作共建跨境直播电 商信用约束机制的基础,尝试构建基于国际商法约束、国际商会自律、国际消费 者协会监督的跨境直播电商信用机制基本体系,并在此机制的基础上探寻行业失 信行为治理的优化路径,创新跨境直播电商信用机制,积极探索适应跨境直播电 商这一新业态特点、有利于境内外各类市场主体公平竞争的信用机制,查处跨境 直播电商商业营销活动中侵犯消费者合法权益、侵犯知识产权、破坏市场秩序的 失信行为,促进跨境直播电商健康发展,为行业参与者营造公平有序的竞争环境、 为消费者营造安全放心的消费环境,进而推进跨境直播电商行业规范发展。

  • In the Internet era, the outbreak of the global epidemic has given birth to the emergence and development of the cross-border live e-commerce market. However, with the rapid development of cross-border live e-commerce, there are also many problems, such as exaggerated product quality, fraud of consumption data and other dishonest behaviors in the industry frequently occur. There is also a lack of credit in the industry to a certain extent, which has greatly damaged the legitimate rights and interests of cross-border live e-commerce consumers and hindered the healthy development of cross-border live e-commerce industry.With the continuous expansion of the scale of the cross-border live broadcast e-commerce industry, the linkage between domestic and foreign markets and the occurrence of dishonesty events has become more and more frequent. Also,the situation of cross-border dishonesty governance has become more and more severe. These have attracted extensive attention from governments of various countries,the International Chamber of Commerce, the International Consumer Association and other relevant institutions. The governance of dishonesty in the industry is urgent, and international cooperation is urgently needed to jointly build an international cross-border live e-commerce credit restraint mechanism. As a new business form of cross-border e-commerce development, live broadcast marketing is characterized by new business model, complex domestic and foreign actors involved, and numerous legal subjects.Therefore, when trying to establish the credit constraint mechanism of cross-border live broadcast e-commerce industry through international cooperation, we should firstly fully take into account its attribute characteristics, industry development status, domestic and foreign regulatory systems, etc. At the same time, it is necessary to clarify the legal responsibilities of relevant subjects in cross-border live e-commerce activities based on international business laws and regulations ; to promote industry self-discipline in combination with the International Chamber of Commerce's regulation on cross-border live e-commerce industry. Last but not least,we should always accept the supervision of the International Consumer Association and protect the legitimate rights and interests of consumers, so as to promote the healthy development of the new business form of cross-border live ecommerce. Considering the current scale of the cross-border live broadcasting ecommerce industry and the existing practical cases of cooperation between countries to build the credit constraint mechanism of cross-border live broadcasting e-commerce between the two countries, it is not only necessary but also feasible to build the credit constraint mechanism of cross-border live broadcasting e-commerce through international cooperation. Explore the reasons for the dishonesty of cross-border live e-commerce industry, put forward the basis for international cooperation to jointly build a credit constraint mechanism for cross-border live e-commerce, try to build a basic system of crossborder live e-commerce credit mechanism based on the constraints of international commercial law, the self-discipline of the International Chamber of Commerce and the supervision of the International Consumer Association, and explore the optimal path for the governance of industry dishonesty on the basis of this mechanism, Innovate the credit mechanism of cross-border live e-commerce, actively explore regulatory methods that adapt to the characteristics of the new business format of cross-border live e-commerce and are conducive to fair competition among various market entities at home and abroad, investigate and deal with illegal acts that infringe upon the legitimate rights and interests of consumers, intellectual property rights and market order in crossborder live e-commerce commercial marketing activities according to law, so as to promote the healthy development of cross-border live e-commerce, Create a fair and orderly competitive environment for industry participants and a safe and secure consumption environment for consumers. It is of great significance to promote the standardization of cross-border live broadcast e-commerce industry and promote the development of cross-border e-commerce.
