摘要:

“绿色化”是习近平总书记在政治局会议上明确指出的发展要求,这一要求 将生态文明建设从经济问题提升为事关发展全局的政治问题高度,是对生态文明 建设思想的升华发展。绿色化作为一种新发展理念,即是对我国经济社会发展的 重大创新,也是应对当下世界经济复苏低迷指明的一条治本之策。 在“绿色化”发展要求推动下,第一届“一带一路”国际合作高峰论坛前夕, 我国四部委联合发布的《关于推进绿色“一带一路”建设的指导意见》中明确提 出,绿色“一带一路”建设以生态文明与绿色发展理念为指导,坚持资源节约和 环境友好原则,提升政策沟通、设施联通、贸易畅通、资金融通、民心相同(“五 通”)的绿色化水平,将生态环保融入“一带一路”建设的各方面和全过程。 总书记在给中国法治国际论坛(2020)的致信中强调,运用法治手段推动共 建“一带一路”、更加有力地应对全球性挑战贡献智慧和力量。因此,在“一带 一路”下提升“五通”绿色化水平,当然也离不开通过法治的推动与保障。但当 下“一带一路”区域的地理和人文环境都极为复杂,绝大多数沿线国家都是发展 中国家,经济发展水平导致其环保理念各有千秋、环境法制参差不齐,同时我国 在沿线国的投资多数为基础设施建设方面的,极易在投资过程中遭遇各种风险, 同时也会影响到中国的大国形象,甚至影响到“一带一路”的共建推进。因此, 实有必要对“一带一路”背景下我国海外投资绿色化法律制度的完善中存在的问 题予以剖析并提出完善对策。 为此本文以海外投资绿色化法律制度为立足点,结合国际国内实践,提出完 善我国海外投资绿色化法律制度的相应的建议和对策,促使我国海外投资绿色 化,实现我国海外投资利益与沿线国家的公共利益平衡,落实“一带一路”倡议 的相应理念,实现绿色“一带一路”国家互利共赢。 本文除引言和结语外,正文部分共分为四个部分。 第一部分是文章的研究前提,对“一带一路”背景下我国海外投资绿色化法 律制度的现状进行考察,分析我国海外投资绿色化法律制度完善的重要意义和必 要性,我国海外投资绿色化法律制度的完善有利于深入贯彻落实领导人讲话精 1 万方数据 神、有助于推动国家重大发展战略在海外落实和有助于保护企业海外投资的合法 权益。 第二部分是针对现状深挖其存在的问题和原因。我国海外投资绿色化法律制 度的完善存在的问题主要从我国海外绿色投资法律保障不全面,缺乏国际环境争 端解决机制,沿线地区环境争端判决承认执行难和金融机构支持绿色化的规定不 完善几个方面展开。 第三部分是文章的实证分析,针对上述问题,广泛考察国际上海外投资绿色 化法律制度的主要实践,并总结相应的经验。主要有美国管辖权的域外适用、“共 同管制”的规制模式、日本和德国对投资企业进行“软法”规范、绿色金融法律 制度的配套借鉴、利用经贸一体化推动绿色合作。 第四部分是文章的落脚点,针对我国的现实并结合国际上的实践经验,提出 “一带一路”背景下我国海外投资绿色化法律制度的完善建议,包括整合我国国 内投资绿色化法律体系、海外投资绿色化争端解决机制选择、环境争端判决的承 认与执行的改革、重视软法对投资绿色化法制的推动、加强我国对海外投资绿色 化法制的推动和利用“一带一路”提升国际法保障六个方面的对策和建议。

  • “Greening” is the development requirement clearly pointed out by General Secretary Xi Jinping at the Politburo meeting. This requirement elevates the status of construction of ecological civilization from an economic issue to a political issue related to the overall development. And “greening” is the sublimation and development of the idea of ecological civilization construction. As a new development concept, “greening” is not only a major innovation in my country's economic and social development, but also a radical solution to the current downturn in the world economic recovery. Driven by the requirements of “greening” development, on the eve of the first “the Belt and Road Initiative” International Cooperation Summit Forum, China’s four ministries and commissions jointly issued the Guiding Opinions on Promoting the Construction of Green “the Belt and Road Initiative” .The construction is guided by the concept of ecological civilization and green development, adheres to the principles of resource conservation and environmental friendliness, and enhances the green level of policy communication, facility connectivity, unimpeded trade, financing, and people’s minds (the “five links”), and integrates ecological and environmental protection in all aspects and the whole process of “the Belt and Road Initiative” construction. In General Secretary Xi Jinping’s letter to the International Forum on the Rule of Law in China (2020), the General Secretary emphasized that the rule of law will be used to promote the joint construction of “the Belt and Road Initiative”, and to contribute wisdom and strength to respond more effectively to global challenges. Therefore, the promotion and protection of the rule of law cannot be achieved without the promotion and protection of the rule of law to improve the green level of the “five links” under “the Belt and Road Initiative” . However, the geographical and cultural environment of the “the Belt and Road Initiative” region is extremely complex. Most countries along the route are developing countries. The level of economic development has led to their own environmental protection concepts and uneven environmental legal systems. At the same time, my country’s investment in the 1 万方数据 西南政法大学硕士学位论文 countries along the route is mostly in terms of infrastructure construction, and it is extremely easy to encounter various risks in the investment process. At the same time, it will also affect China's image as a major country, and even affect the joint construction of “the Belt and Road Initiative” . Therefore, it is necessary to analyze the problems existing in the greening legal system of overseas investment in my country under the background of “the Belt and Road Initiative”and propose perfect countermeasures. Therefore, this article takes the greening legal system of overseas investment as a foothold, combined with international and domestic practices, and proposes corresponding suggestions and countermeasures to improve the greening legal system of my country's overseas investment, so as to promote the greening of China's overseas investment and realize the benefits of my country's overseas investment and the countries along the route. Balance public interests, implement the corresponding concepts of “the Belt and Road Initiative” and achieve mutual benefit and win-win results for green “the Belt and Road Initiative” countries. In addition to the introduction and conclusion, the main body of this article is divided into four parts. The first part is the research premise of the article. It examines the status quo of my country's overseas investment greening legal system under the background of “the Belt and Road Initiative” and analyzes the significance and necessity of China's overseas investment green legal system under the background of my country's“the Belt and Road Initiative” . The greening legal system of China’s overseas investment is conducive to the in-depth implementation of the spirit of the leader’s speech, to promote the implementation of major national development strategies overseas, and to protect the legitimate rights and interests of enterprises in overseas investment. The second part digs into its existing problems and reasons in view of the status quo. The problems of my country's overseas green investment legal system are mainly from the incomplete legal protection of China's overseas investment greening, lack of international environmental dispute settlement mechanism, difficulty in enforcement of environmental dispute judgments in areas along the route, and imperfect regulations for financial institutions to support greening. The third part is the empirical analysis of the article. Aiming at the above problems, it extensively examines the main practice of the greening legal system in overseas investment in the world, and summarizes the corresponding experience. 2 万方数据 “一带一路”背景下我国海外投资绿色化法律制度的完善 Mainly it includes the extraterritorial application of the jurisdiction of the United States, the “common control” regulatory model, the “soft law” regulation of investment companies in Japan and Germany, the supporting reference of the green financial legal system, and the use of economic and trade integration to promote green cooperation. The fourth part is the foothold of the article. Aiming at the problems of the second part and combining the experience of the third part with the current situation of China in the first part, it puts forward suggestions on the improvement of the greening legal system of China’s overseas investment under the background of “the Belt and Road Initiative” , mainly including integration China’s domestic greening investment legal system, choice of overseas investment green dispute resolution mechanism, reform of the recognition and implementation of environmental dispute judgments, emphasis on soft law's promotion of greening investment legal system, and strengthening of China's promotion and use of overseas investment greening legal system “the Belt and Road Initiative” measures and suggestions to enhance the protection of international law in six aspects.
