摘要:

我国目前正处于计划经济向市场经济转型时期,随着国有企业经营管 理体制的改革,通过多种方式,全国各地发生了大量国有资产流失案件。 此外,工业化进程的推进,也导致了诸多侵害社会公共利益的案件频频发 生,如环境污染、假冒伪劣产品的泛滥等案件。面对诸如此类的大量案件, 在缺乏原告或原告不到位的情况下,检察机关作为我国的法律监督机关, 为了维护国家利益和社会公共利益,挺身而出,向侵害人提起了民事公益 诉讼。但是,现行法律却没有明确规定检察机关可以提起民事公益诉讼, 所以,检察机关介入民事公益诉讼的行为仍难免某种尴尬。基于此,本文 从检察机关介入民事公益诉讼的法理分析、社会需求、制度建设、立法完 善等方面入手,探讨了检察机关提起民事诉讼的法律问题,旨在为检察机 关对民事公益诉讼的介入走向法制化做一点贡献。 本文共分五部分。 第一部分是检察机关对国有资产流失案件提起民事公益诉讼的案例 及思考。首先,介绍了近年检察机关对国有资产流失案件提起民事公益诉 讼的三个典型案例。其次,阐述了检察机关介入民事公益诉讼的法律理论 争议和民事诉讼法相关法律规定的缺位。 第二部分是检察机关介入民事公益诉讼的必要性分析。首先,是法理 分析。在对公益诉讼和我国检察权性质阐述的基础上,主要从检察权性质 的角度分析了检察机关介入民事公益诉讼的必要性。其次,从社会现实发 展和需要的角度分析了检察机关介入民事公益诉讼的必要性。 第三部分是检察机关介入民事公益诉讼的方式分析。首先列举了我国 检察机关目前提起民事公益诉讼的方式类型,然后对这些方式进行了理性 分析,并设计了我国检察机关介入民事公益诉讼的合理模式。 第四部分是检察机关提起民事公益诉讼的案件范围、原则和程序分 析。首先,将检察机关提起民事诉讼的案件范围划定为国家利益受损害案 件、公共利益受损害案件、社会弱势群体利益受损害案件、不能维权的公 民个人利益受损害案件四类,其次,对检察机关介入民事公益诉讼的原则 和程序进行了详尽的分析。 第五部分是检察机关提起民事公益诉讼的立法完善。从立法上提出了 建立检察机关介入民事诉讼制度的几项建议。一是完善宪法关于检察权的规定;二是在民事诉讼法中明确规定检察机关具有提起民事公益诉讼的诉 权;三是在其它相关法律中完善检察机关提起民事诉讼的范围。

  • Nowadays our country is at the period in which the planned economy is transferring to the market economy. Because of the economic structural reforms of the state-owned enterprises, a great deal of state-owned assets is lost through different ways in many cities in our country. Meanwhile, with the development of industry, the public benefits are ingringed, for example, the environment has been polluted, more fake products have been manufactured. Facing this situation, in order to safeguard the interests of the state and the public, the procuratorial organ, as the state legal supervision organ, comes out boldly to take civil public benefit proceedings against the infringers without accusers or with the absence of accusers. On the orther hand , the procuratorial organ’s rights to bring the civil public benefit to court is not definitely stipulated by law in effect, so it is embarrassing for the procuratorial organ to intervene civil proceedings. Based on this, this paper deals with the legal problems that the procurational organ brings civil public benefit proceedings to court by analyzing jurisprudence, social demands, system construction and the improvement of the legislation, so as to make some contributions to making the procuratorial organ easier to intervene the civil public benefit proceedings. This paper is divided into five parts. The first part is about the cases and thoughts that the procuratorial organ has taken civil public benefit proceedings against the loss of the state-owned assets. Firstly, this part introduces three typical cases that the procuratorial organ has taken the civil public benefit proceedings against the loss of the state-owned assets. Secondly, it elaborates its legal theory arguments and the incomplete system stipulated by the civil procedure law. The second part analyses the necessity that the procuratorial organ intervene the civil public benefit proceedings. Firstly, this part analyses the jurisprudence, mainly the necessity that the procuratorial organ intervene the civil public benefit proceedings in view of public benefit proceedings and the characters of procuratorial right. Secondly, it also analyses the necessity that the procuratorial organ intervene the civil public benefit proceedings based on social developmentand demands. The third part analyses the forms of procedure that the procuratorial organ intervenes the civil public benefit proceedings. Firstly, this part cites the forms in which procuratorial organ intervenes the civil public benefit proceedings nowadays. Secondly, it also analyses those forms reasonably and designs a reasonable mode that the procuratorial organ intervenes the public benefit proceedings. The fourth part analyses the scopes, the principles and the procedures of the cases that the procuratorial organ brings public benefit proceedings to court. At first, this part designates the case scopes of the procuratorial organ bringing public benefit proceedings to court as the four types of the damages, such as the damage of state interests, the public interests, the interests of vulnerable groups and citizens who can not safeguard their own rights. Then, it also analyses the principles and procedures that the procuratorial organ intervenes the civil public benefit proceedings in detail. The fifth part deals with improving the legislation that the procuratorial organ intervenes the civil public benefit proceedings and from the legislation puts forward several suggestions that the civil procedure system that the procurator organ intervenes the civil proceedings should be constructed. First, the procuratorial rights should be stipulated by constitution, Second, the procuratorial organ’s rights to bring the civil public benefit proceedings to court should be definitely stipulated by the civil procedure law. Third, the scopes that the procuratorial organ brings the civil public benefit proceedings to court should be broaden in other relevant laws.
