摘要：

世界性的粮食危机仍然堪忧，08 年上半年度甚至有些国家为此发生了一定程度的暴乱，尽管下半年又趋于缓和，但这一切足以说明农业问题在当今世界的重要性。农产品贸易也由此成为国际贸易领域中最敏感的部门之一，因而无论是 WTO 规则还是各个国家的具体国内农业法律和政策，都对农产品贸易做出了特殊的规定。在众多针对农业的政策措施中，黄箱补贴这一农业政策更加值得我们去关注。本文即是首先从补贴的基本概念入手，介绍了补贴制度的总体情况，然后对《农业协定》所规定的黄箱补贴进行具体的阐述，揭示了其与 WTO 公平贸易原则的关系。其次，文章通过介绍世界主要国家关于黄箱补贴的做法，发现同样的贸易政策在发达国家和发展中国家却具有截然不同的表现这一事实，以及由此所引发的南北矛盾和北北矛盾的升级，集中表现为旷日持久的多哈回合贸易谈判始终无法取得实质性的进展。随后对于有关黄箱补贴争端解决，文章分别介绍了权力导向型和规则导向型即相对应的国内和国际两种争端解决方式，并根据中国的实际情况提出了一种特殊的政治性的争端解决模式。接着，文章指出了中国在此种贸易氛围下需要制定的因应之策，提出了我国在黄箱补贴问题上所应采取的法律对策以及具体的综合性措施的若干建议。文章的最后，是对中国农业发展战略的些许展望。

  • Worldwide food crisis still arouse great concerns., a certain degree riots were even broken out in some countries for this reason during the first part of 2008, which quite explained the importance of agricultural problems in today’s world though some relaxation of tensions for this crisis was brought about for the second part of the year. Trading for agricultural produce has became one of the most susceptible part of the area of international trading,special rules were exclusively formulated for the trading of agricultural produce regardless of the regulations of the WTO or specific agricultural act and policy domestically for each countries. Subsidy of Amber Box Policies,this agricultural policy does much merit our attention among all these measures directed against agricultural policy. This essay firstly begin with the basic concept of the subsidy,introducing the general information of the system of subsidy,then interpreting the Amber Box Policies subsidy regulated by agricultural treaty and revealing its connection with fair trading principle of the WTO. Secondly the fact was discovered throught the introduction of the methods about Amber Box Policies subsidy by this essay from the major counties of the world,that the tremendous different effects had between the developed countries and developing countries on the basis of the same trading policy and the conflict escalated between the south-north and north-north because of it, which mainly manifest non material development could be achieved by this protracted Doha Round negotiation. Afterwards this essay respectively make the presentation of the type of power orientated and the type of rule orientated,which correspond to the two types of methods of dispute resolution from domestic and worldwide, and advance a unique pattern of political dispute resolution according to the real situation of China. It further points out the corresponding tactics which China needs to formulated under this business environment, and puts forward a plan of the law countermeasure which China should adopt on subsidy of Amber 2 Box Policies and makes several suggestions about specific comprehensive measure.The last of this essay is some expectation for China agricultural strategic development.
