城乡统筹视野下的交通综合行政执法体制改革研究——以重庆市交通综合行政执法制度改革现状为研究样本

摘要:

目前现行的交通行政执法管理体制存在诸多问题。从全国来看,交通行政执法体制多种形式并存,存在着条块分割,政令不畅;政出多门,管理混乱;审批权与处罚权不分,监督机制不健全;执法机构臃肿,行政执法成本高、效率低的问题,甚至在某些地方,由于部门利益的存在,各交通执法部门之间明争暗斗,造成了极坏的社会影响。而相比全国交通行政执法体制的上述不足而言,农村的交通行政执法管理工作更趋薄弱和混乱,执法管理机构缺失、权责不清、保障不力,导致管理缺位,农村公路与城市道路相比,安全形势更趋严峻、交通事故死亡率居高不下、运输管理市场严重混乱,路产路权得不到有力维护,道路的建管养工作严重滞后,上述问题的存在归根结底在于城乡交通管理体制上存在的巨大鸿沟。 作为交通行政执法体制改革的先行者和城乡统筹综合改革试验区的重庆市,在这个领域具有较强的实践优势和样本效应。在科学发展观的指导下,以城乡统筹发展为契机,参照重庆模式,针对交通行政执法体制城乡统筹模式进行专项研究,具有理论与实践的双重意义。 本文运用制度分析法、实证分析法、历史分析法,以重庆模式为主要研究对象,从以下几个方面入手,对城乡统筹视野下的交通行政执法体制的改革进行剖析:(一)交通行政执法体制的现状研究:通过对全国与重庆的交通行政执法体制的发展脉络与现状的分析,厘清目前的交通行政执法体制。(二)城乡统筹视野下的交通行政执法体制研究:首先论述城乡统筹的内涵与要求,并分析其发展状况;其次指出在城乡统筹的背景下,改革现有的交通行政执法体制的必要性与重要意义;(三)构建城乡统筹视野下的交通综合行政执法体制:首先分析交通行政综合执法体制改革的理论依据;其次,分析现有的重庆交通行政执法模式与城乡统筹要求之间存在的差距;最后,从职能转变、改革的保障机制的建设入手,构建一个趋近完善的城乡统筹的交通行政综合执法体制。

  • At present there are many problems in traffic executive management and its law enforcement. There exists a lot of forms of systems of law enforcement, such as the fragmentation of the whole law system, unsmoothness of the political orders, mixed management, no difference between the right of examination and the punishement, and the unfunction of supervision system. The problems, such as the overcrowdness of law enforcement institutions, the high cost executive law-enforcement and the low efficiency caused very negative influence in some places because of their finding faults for each other for their own benefits. Compared with the above-mentioned shortbacks in the nation-wide traffic law enforcement, the same problems in rural China are more serious. In rural China, the problems are as follows: the short of executive management institutions, unclear poweres and responsibilities, and weak ensurance. These problems contribute to the lack of position in management. In contrast with the city roads, the roads in countryside do not enjoy such high security as that in city roads, which resulted in higher rate of traffic death, the chaos transportation management market, and ill protection of the rights of roads. All of the above problems are caused by the great drawbacks in the municiapl and rural traffic management. Chongqing, as the experiemental reform city of the unification of rural and municipal development and the pioneer of traffic law enforcement, has a greater practical advantage in this field, and it set a good example for us. Under the guidance of scientific development, taking the entire municipal and rural development as an opportunity, we should make an research with the example of Congqing, which will surely have a double significance in theory and practice. This paper, with the methods of system analysis, demenstration analysis, and historic analysis, according to the mode of Congqing. has made an reasearch on the reform of traffic law-enforcement in municipal and rural places. It includes the following points: I. The study on the current situations of the traffic law-enforcement. Through the analysis of the nation-wide and Congqing’s development in traffic executive law-enforcement, this paper has explained well 2 the present traffic law-enforcement. II. The study on the traffic law-enforcement under the view of co-development of traffic in municipal and rural places. First it talked about the connotation and demand of the traffic development in city and countryside. Second, it pointed out the significance of reforming the present traffic law-enforcement systems under this background. Third, creating the system of traffic law-enforcement in the view of co-development of city and countryside. First, it analyzed the theoretical foundation of the complex traffic law-enforcement, second, it analyzed the gap between the present traffic law-enforcement modes in Congqing and the demand of the co-development in rural and municipal traffic. Finally, it talked about how to creat the best system of law-enforcement in traffic development in municipal and rural places.
