近年来,随着我国电信市场的不断发展,电信服务与消费日趋成为国 计民生的重要组成部分,而我国电信业“重建设、轻监管”的问题越来越 突出,电信消费者应有权益受损现象已经普遍存在,如何解决当前我国电 信业存有的各种社会矛盾,已经成长为倍受社会各界共同关注的热点问 题。本文通过对我国电信监管体制之现状进行深入分析,找出其所存缺陷 及其缺陷存在之原由,并在归纳和总结国际发达电信国家的监管模式先进 经验的基础上,结合我国电信市场垄断性经营现状,进而得出结论:针对 电信市场的现状,要切实保护消费者的合法权益,解决我国电信业中存在 的诸多问题,加强电信监管已势在必行。全文 4 万余字,分为四个部分: 第一部分,我国电信监管之现状。这部分首先对电信监管的涵义进行 界定,搞清电信监管的功能与任务;其次是对我国电信监管历次改革与电 信行业发展分阶段阐述和分析。我国电信监管诸次改革可分为四个阶段 来,它们分别是:1994 年以前的严格监管期、1994~1998 年的市场机制 与监管转轨期、1998~2007 年的市场管制探索期,2007 年年底始的现代 电信监管改革与完善期。在对我国电信监管历史现状进行阐述的同时,分 析和归纳了各阶段所取得的成就。 第二部分,我国电信监管缺陷研析。本部分首先对我国现行电信监管 体制存在的问题进行多层次、多角度分析,得出我国现行电信监管体制存 在法律滞后、政策失当、监管机构存在致命缺陷、监管内容和措施设置不 够科学合理等结论;并进一步分析和论证了我国政府对电信运营商长期性 和普遍性的不适当监管,造成我国电信消费者应有权益长期性和普遍性地 受到损害的严重后果;接着从我国历次电信业改革的历史教训和现存电信 市场主体构成出发,得出唯有加强和不断改善电信监管体制才是解决我国 电信业所存问题的最佳路径。 第三部分,国际电信监管模式。主要以美国、英国和日本等国家的电 信监管为例,从其电信监管法律体系、监管机构及其职能、监管内容和监 管手段等方面,对国际各电信监管模式进行优缺性分析;并在此基础上总 结出我国电信监管体制改革应借鉴的国际先进经验。 第四部分,我国电信监管法律制度之完善。首先认定良好的电信监管 应以较为完备的电信监管法律体系存在为前提,接着从立法高度提出我国电信监管法律应有之规定和改进这举措,并着重强调出台《电信法》的必 要性和紧迫性;其次论证了建立独立的电信监管机构是实现电信监管良好 效应的最佳保障,以及我国应建立独立电信监管机构的重要性;再次论述 了电信监管的内容和措施应当科学合理,并主要从电信市场准入监管、互 联互通监管、电信资费监管、普遍服务以及服务内容和质量等几个方面加 以阐释和论述;最后提出监管机构也应被监管,而且监管国家电信监管机 构的主体应为广大电信消费者、司法系统和新闻媒体等社会主体的理论。

  • With the increasing development of the telecommunication market of China in recent years the services and the consumptions of the telecommunication become the important part of the national economic and the basic living. However the problem in the industry of telecoms that is “focus on the construction with less supervisions” are getting more and more serious and the damages to the consumers’ interests are universal. And how to solve these social contractions in the industry of telecoms has become the hot issue that is focused by the public. This dissertation is trying to analyze the current supervising system in telecoms then to find its defects and the reasons to conclude and summarize the advanced experiences of the supervising models in telecoms of the developed countries as the ground and the current monopoly situation of the telecoms market in China: for the current circumstance of the telecoms market, it must protect the consumers’ interests feasibly and solve the several problem in the telecoms industry in China that is to enforce the supervisions of telecoms which is the necessary one. The whole text is divided into four parts which are totally about 40 thousand words: Part one is the current situation of the supervisions of telecoms in China. In this part the author firstly definitely give the concept of the supervision of telecoms and certain the functions and tasks of the telecoms supervision. And the author raised that the several reforms in the telecoms supervisions would be classified into the following four stages that are the strict supervising period before 1994; the transformation of the market and the supervision period in 1994-1998; the researching period of the market supervision in 1998-2007 and the reforms and perfections of the modern telecoms supervisions from the end of 2007. As the elaborating the current history of the telecoms supervisions in China, the author analyzes and summarizes the achievements in every stages. Part two is the studies and analysis of the defects among the telecoms supervisions. In this part the author chiefly analyzes the existing problems in the system of telecoms supervisions in today’s China from the multi-levels and aspects and concludes that the problems in the current system such as the drags in laws, the wrong polices, the fatal defects , the contents and the facilities in the supervising units and makes a further step to the analysis anddemonstration on the improper supervision of the long term and general ones by the Chinese government which caused the serious results that the damages to the consumers’ interests and benefits in the long-term and common ones. Then the author also indicates best way to resolve the existing problems in the industry of telecoms that only to enforce and improve the system of the telecoms supervisions form the several historical lessons in the reforms and the current constitution of the market subjects in China. Part three is the models of the international telecoms supervisions which are mainly including the American, Britain and Japan systems as the examples. The author gives an analysis over the defects of the various models of the international telecoms supervisions from the perspectives of legal system, the constitutions of supervision and its duties, the contents of supervisions and the measures and so on. Then taking the mentioned above as the base, the author summarize the advanced international experiences which could be adopted in the reforms in the system of telecoms supervision in China. Part four is the perfections about the system of telecoms supervisions in China. At first the author insists that the excellent telecoms supervisions should take the legal system of telecoms supervisions as the preconditions and rise the ought-be rules and improvements of the laws of telecoms supervision from the degree of the legislation in China and focus on the necessity and the urgency of the law of telecoms. Secondly the author demonstrate the importance to establish the constitution of telecoms supervision in China; thirdly is the elaboration about the contexts and the scientific means of telecoms supervision which are explained and presented from the entrance of the market, the cooperated supervisions, the fees of telecoms, the general services and the qualities and the contents and so on. Finally the author suggests that the supervising constitution should be supervised as well and the supervising social subjects must be the large amount of consumers, the judicial systems and the news media in telecoms.
