劳动教养制度作为极具中国特色的一项法律制度,长期的实践证明, 其在维护社会秩序,预防犯罪方面功不可没,但它的存在和运行却始终游 离于法治之外,与我国正在进行的法治建设特别是刑事法治建设的要求不 相适应。劳动教养发展到今天,已经成为牵涉到刑事和行政两大法律体系 的一个综合问题,鉴于其制度本身的复杂性,积弊的深层,对现行劳动教 养进行整体的确认和改造已不可能。对劳动教养制度的运行轨迹和现状, 以及对象的结构、特征进行调查分析,将对象进行分类处置,并站在法治 一体化的高度,对行政处罚与刑事处罚之间限制人身自由的处罚进行清 理、归并,推动刑事法和刑事处罚整体结构的完善,或许从中可以找到劳 动教养的出路。 全文分 六 部分,共 22158 字数。 第一部分,对现在劳动教养管理所收容对象的调查和简要分析。从对 象结构来看吸毒人员占到收容对象整体比例的69%,且吸毒人员中大量人 员具有违法犯罪行为,强制戒毒与劳教戒毒功能重复,效率低下。其他人 员中财产型和滋扰型罪错人员较多,其中尤以财产型中的盗窃、两抢、诈 骗等传统的治安型罪错人员为多,在对这些类人员具体案例的调查中笔者 发现,可对这些人员再作分解处理。 第二部分,从调查情况中可以看出劳动教养制度的滞后性。第一,劳 动教养制度理念过时;第二,劳动教养对象、范围缺乏法律明确规定;第 三,对象受到人身强制的处罚程度与其违法程度不相当;第四,劳动教养 审批缺乏程序控制。 第三部分,劳动教养的合理功能有保留的必要。尽管劳动教养制度存 在诸多弊端,但其部分功能的合理性仍然值得肯定,其理由:一是它对维 护社会治安,保护最大多数人的最大利益起着积极作用;二是它能弥补我 国刑法的结构性缺陷。但劳动教养制度必须要改革。 第四部分,谈对劳动教养制度改革的设想。对劳动教养制度整体上进 行转化是不可能的,鉴于劳动教养制度的复杂性,劳动教养收容对象的复 杂性,只能对劳动教养对象进行分类分解处理。根据调查情况看,将劳动 教养对象分为吸毒人员、常习性违法人员和轻微犯罪行为人员三类,进行 分别处置较为科学。对吸毒人员给予行政性的强制隔离治疗,对常习性违法人员给予治安管理处罚就够了,对轻微犯罪行为人可以作轻罪处理。 第五部分,谈劳动教养制度改革的重点问题——轻罪处理。就轻微犯 罪人员行为的性质而言,是可以将其认定为犯罪的,并可以将刑法规定的 管制和拘役的犯罪一起作为轻罪,对轻罪可以给予非刑罚的处罚,以弥补 我国刑事法网粗疏,刑事处罚体系不完善的缺陷。 第六部分,结论。劳动教养对象进行分类处置之后,对吸毒人员的处 理就是行政强制措施,对常习性违法人员的处理就是行政处罚,对轻微犯 罪行为人的处理就是一种刑事处罚。这种处理方式应该是既能保留劳动教 养的合理功能,又能完善我国刑事法网的一种较为科学的方式。
