摘要:

为适应社会主义市场经济条件下劳动关系的要求,我国相继颁布了一系列有关处理劳动争议的法律、法规和司法解释,构筑了现行“一裁两审”的劳动争议处理体制,以化解劳动关系矛盾、促进劳动关系的和谐发展。当前,劳动关系已经成为了我国最基本、最广泛的社会关系,劳动关系的和谐稳定直接关系到整个社会的和谐稳定。但是,随着非公有制企业的大量出现,由于此类企业中劳动关系双方主体力量的不均衡,强势的用工单位往往会侵害弱势的劳动者,而且企业内缺乏劳动关系的自我协调机制,随之引发的劳动争议大大增加,我国劳动关系矛盾的冲突性凸显。可以看到,劳动关系己经暴露出失衡甚至对抗状态,长此以往必然会影响整个社会的稳定与发展。 劳动争议处理体制设定的目标是通过依法、公正、及时地化解劳动争议,以平衡劳动关系双方力量,抑制资本的劣根性、加强对劳动者权益的维护,实现社会的公平与公正,促进社会主义市场经济的有序发展。然而,现行体制不仅在构建上,而且在实践中遇到了诸多问题和挑战,己经不能够适应甚至滞后于市场经济条件下劳动关系的发展需要。体制在运行中出现了企业劳动争议调解委员会的虚化、劳动仲裁功能的弱化以及劳动争议的诉讼化倾向的现状,已经偏离了体制原来设定的目标,整个体制运行的效能非常低。通过重构与完善现行体制来提高其效能,使之符合劳动争议的处理要求,已迫在眉睫。 本文以构成劳动争议处理体制的两个基本要素即劳动争议仲裁制度、劳动争议诉讼制度为研究的主线,对现行体制诸如效率、权威性和公正性等方面所存在的弊端分析原因并针对体制存在的弊端,充分考虑了现实环境、改革成本等因素,在借鉴国外市场经济国家劳动争议处理体制模式的基础上,建议我国建立“或裁或审、各自终局”的劳动争议处理体制。具体来说,在劳动争议仲裁制度上,推进劳动仲裁机构实体化;在劳动争议诉讼制度上,选择“特别专审非独立型”,在法院设立劳动法庭专门审理劳动争议。

  • To meet the need of labor relations in the socialist marketing economy series of laws regulations and judicial interpretations related with the labor dispute are enacted and these form the existing labor dispute hand1ing mechanism mediation arbitration and double-lawsuit,in order to solve the contradictions of the labor relations and to promote the harmonious development of the1abor re1ations. At present,labor relations has been the basica1 and the broadest social relations,and its harmony directly concerns the harmony of the who1e society. However , with the rise of non-state-owned enterprises,because of the imbalance of the two parties in these enterprises , the advantageous capital always infringes the disadvantageous laborers .Besides , forthe1ack of the self-coordination mechanism in these enterprises,and the increasing of the subsequently triggered arbitration the labor relations contradiction highlights. obviously,the labor relations has revealed a kind of imbalanced even confrontation status,and if things continue in this way the stability and development of the who1e will be affected. The aims of the 1abor dispute handling mechanism are to balance the two parties, to suppress the defection of the capital,to protect the laborers,rights and interests,to realize the social equity and justice,and promote the orderly development of the socialist marketing economy. However the existing system cannot adapt to,even lags behind,the development of the labor relations in the sociaIism marketing economy system,and encounters many problems and challenges both in the es1ab1ishmen of the system and the more in practice. The weakening of the labor dispute mediation ,the function weakening of the labor dispute arbitration and the tendency to Iawsuit appear in the practice of the system,all of these have deviated from the designed aims, and affected the efficiency of the system. The extremely urgent task at present is to construct and compIete the existing system and to enhance its efficiency,eventua11y to meet the need of the handling the labor dispute. 2 Through study the two basic factors of the labor dispute hand1ing system, namely, the policy of labor dispute mediation,the policy of labor dispute arbitra1ion, the policy of labor dispute law procedure,this paper analyses the abuse of the existing system from the aspects of efficiency,authority and justice,etc. And with the basis of filly allowing for the real-life situations and the reform costs , and borrowing ideas from the model of the marketing-economy countries,recommends the establishment of "separation of arbitral and judgment and ending separately" . In arbitration system, accelerating the arbitration's institute and selecting the legislative institute that is "special and exclusive judgment non-independently”in the judicial body. In court system ,building labor court to solve employment disputes.
