摘要:

对一个系统而言,体现各部分相互作用方式和过程的“机制”无疑具有关键作用, 尤其是在该系统已经建立、相应体制和组织也已经确立的情况下。职务犯罪侦查,作为 查办贪污贿赂、渎职等智能化特征突出的职务犯罪的专门工作,建立科学合理的机制尤 为重要。 全文共分五个部分,约 40000 字。 第一部分为职务犯罪侦查机制一般问题。职务犯罪侦查机制,是指检察机关职务犯 罪侦查的构成要素之间相互作用的过程和方式。职务犯罪侦查机制包括指挥、协作、激 励、评价、保障和监督六大机制,其中指挥、协作、激励和评价是更为直接和重要的核 心机制,本文也将有针对性地只对这四大核心机制进行分析讨论。职务犯罪侦查机制是 开展职务犯罪侦查工作的前提基础,是实现职务犯罪侦查目的的必要条件,是完成职务 犯罪侦查任务的重要保证。 在英美法系国家,职务犯罪侦查职能一般为多个侦查机关行使,较为分散,但侦查 机制较为灵活。大陆法系国家大多实行检警一体化,分工不明确,检察官的指挥较有权 威,协调有力。混合法系国家兼具英美法系和大陆法系的特征,指挥机制大多实行一体 化。而我国历来十分重视对官员贪污腐化的惩处,大多赋予查办人员较为强大的职权。 近现代时期我国注重对国外职务犯罪侦查机制的借鉴,并做了符合我国实际状况的探 索。在中国共产党成立并建立新中国后,尤其是改革开放以来,我国的职务犯罪侦查机 制建设取得突出成绩。 随着反腐败斗争的深入,随着职务犯罪活动的演变,检察机关除了面临职务犯罪活 动发展变化带来的新挑战外,还面临质疑检察机关侦查权配置合理性、加强监督、新律 师法实施以及同步录音录像带来的压力。现行的职务犯罪侦查机制尚存在不少问题和不 足,如对职务犯罪侦查机制的重要性认识不足、缺乏系统研究,侦查资源缺乏整合,效 益不佳,侦查指挥中心等机构职能不清,部门之间协作不佳等。对此,需要立足我国国 情和现状,遵循职务犯罪侦查工作的特点和规律,突出重点、注重实效,不断建立和完 善我国的职务犯罪侦查机制,尤其是四大核心机制。第二部分为职务犯罪侦查指挥机制。职务犯罪侦查指挥机制的重要性不言自明。目 前的职务犯罪案件指挥机制存在侦查指挥中心定位模糊、侦查力量分散、侦查资源综合 利用不充分、指挥效率不高、信息情报和线索管理等基础建设落后等问题。在完善指挥 机制上,可以从六个方面进行:完善内设机构设置、完善指挥中心建设、完善案件线索 管理、加强信息情报建设、研究制定科学合理高效的指挥模式、建立统分结合的侦查力 量配置体系。 第三部分为职务犯罪侦查协作机制。职务犯罪侦查协作机制在目前跨地区作案、窝 案串案、携款潜逃案件增多的形势下,在查办难度增大的状况下,具有重要作用。目前, 职务犯罪侦查协作存在地方保护主义干扰、协作机制不健全、协作责任规定不完善等问 题。在以后,要注重完善内外部协作。在内部,整合反贪与渎检部门,自侦与其他部门、 以及各级各地检察机关之间的协作。在外部,妥善、正确处理好与纪检监察部门的协作, 加强与其他有关部门的协作,积极拓展国际协作。 第四部分为职务犯罪侦查激励机制。职务犯罪侦查激励机制在调动侦查人员积极 性、高效进行侦查工作方面具有特殊意义。现行的激励机制内容缺失,政策随意设定, 欠缺规范、科学和系统。要将侦查人员进行适当分类,制定有针对性、有差别的激励方 案。此外,要改善激励环境,引导侦查人员调整需求。还要建立科学合理的考核评价体 系作为支撑。 第五部分为职务犯罪侦查评价机制。职务犯罪侦查评价机制可谓侦查工作的“指挥 棒”。我国职务犯罪侦查评价机制属于传统型,具有专政评价特征,追求法律监督的政 治价值,并存在一定功利性。存在的问题主要是评价标准片面、不确定和不完整,评价 机构不健全,对社会外部评价重视不够。对此,要科学设定评价体系建立健全评价机构, 建立对侦查行为和侦查效果的整体评价,并扩大社会民众对职务犯罪侦查工作的评价参 与面,重视社会舆论和新闻媒体的评价。

  • The mechanism, manifesting the interaction and process of different parts in one system, has an important function, especially in the situation that the system and the corresponding organization has already established. For the investigation of occupational crime, which is used as special methods to investigate the crime of corruption﹑bribery or malfeasance , characterized as intellectualized,establishing scientific and reasonable mechanism is particularly important. The essay contains five chapters,approximately 40000 characters. Chapter one is the general theory of the mechanism of occupational crime investigation. It defines the investigation mechanism as the process and ways in which the procuratorial organs inquiry into the occupational crimes. According to this definition, the mechanism should include six mechanisms: commanding,cooperation,inspiration,evaluation,safeguard and supervision. The next four chapters will focus on the four chief and key mechanisms: commanding,cooperation,inspiration and evaluation. In general, the mechanism is a precondition to investigation of occupational crime, a necessary requirement and vital guarantee for the goal and accomplishment of investigation. In common law countries, the function of occupational crime investigation is executed by different state organs and the investigation mechanism is characterized as flexibility. However, in civil law countries, which apply integration of police and procurator, the functional division of criminal investigation is indefinite. The procurator is in charge of the investigation and has powerful authorities to manage coordination. In mixed legal system countries, consisting of features of both civil law and common law countries, the commanding mechanism features integration. In China, as a tradition of applying severe punishment to the crime of corruption ﹑bribery and malfeasance, the investigator was given powerful authorities. In recent years, more attention have been paid to the foreign mechanism of occupational crime investigation and new exploring methods have been adopted with outstanding performance, especially after the reformation and opening up policy was introduced. In the course of intensifying the struggle against occupational crimes, the procurator organs, facing the challenges caused by the evolution of those crimes and the implementing ofChina’s new Lawyer Law, confronted with the pressures resulting from synchronous recording of sound or video, will probably be questioned about the rationality of the investigation and the supervision power. The ongoing investigation mechanism has many problems, such as the lack of systematic study, the irrational setup of organizations, the indefinite function of investigation organs and the unsatisfactory cooperation among different agencies. To resolve these problems, we should , on the basis of the national condition and experience, respect the disciplines and unique features of occupational crime investigation, establish and develop the mechanism fitting for our country, especially the four key mechanism. Chapter two is an analysis of commanding mechanism of occupational crime investigation. It reviews the current commanding mechanism from law and practice aspect and points out the defects: the vague position of commanding center, the dispersed investigation forces, the inadequate use of investigation resources, the lower efficiency of commanding, the backward fundamental work of information management and case clue management,and so on. According to the analysis, six methods should be taken to improve the commanding mechanism: perfecting the inner organization,improving the administration of commanding center, developing the management of case clues, strengthening the management of information, building scientific and efficient commanding mode, establishing configuration system combining centralization and decentralization for investigation forces. Chapter three discusses the cooperation mechanism of occupational crime investigation. In the situation of growing trans-regional crimes,interrelated crimes and abscondences of criminal suspect with property, cooperation mechanism becomes more important in investigation. The essay scans the actual performance of cooperation mechanism and points out the main problems: the inference of local protectionism, the inadequacy of cooperation system and the lack of cooperation liability. On the basis of above research, the cooperation internal and external should be strengthened. For a better internal cooperation, we should integrate the cooperation of anti-corruption agency and anti-malfeasance agency, self-investigative division and other divisions, local and out-regional procuratorial organs. For a better external cooperation, we should properly deal with the relation with discipline inspection department and supervision department, strengthen the cooperation with other state organs, and explore the possibility of international cooperation. Chapter four is the inspiration mechanism of occupational crime investigation, which isof great importance in encouraging the investigator to inquiry into the crimes actively and efficiently. The current inspiration mechanism lacks substantial institutions and the guiding policies are set up by random. So it is urgent to make a classification of the investigator and build differentiated inspiration program accordingly. Besides, improving the inspiration environment , adjusting the needs of investigators and building up reasonable evaluation mechanism are also of great importance. Chapter five researches on the evaluation mechanism of occupational crime investigation, which is seemed as “baton” of investigation. The present evaluation mechanism, serving political purpose, has some traditional characteristics and is strongly utilitarian. The problems with this evaluation mechanism are one-sided and indefinite evaluation criterion, the inadequacy of evaluation agents and ignorance of the external evaluation. Since these problems are no simple matter that can be settled quickly, much work, including setting up scientific evaluation criterion, building up adequate evaluation agents, developing overall evaluation system for the acts and effects of investigation, seeking suggestions from the public and attaching great importance to supervision by the news media, has to be done.
