摘要:

物权法的颁布从立法上解决了不动产专门法缺失的问题,也解决了不 动产登记效力的问题。但是基于客观的历史原因,基于各个主管行政部门 的利益平衡问题,基于立法的技术考虑,物权法并没有一揽子解决我国不 动产登记中存在的全部主要问题:在物权法出台之后,事实上没有完全取得 统领性的地位,相当多的关联法规还在发挥原有作用,存在于其中的立法 不协调的矛盾没有得到克服;权属证书不统一,权利人因而凭借行使权利 的基础并不牢靠;信息查询不方便,错误频出,对于不动产登记的公信力 产生很大的冲击;对于因不动产登记机关的错误而产生的登记瑕疵,如何 保证权利人的利益和救济,包括物权法在内的相关法律都没有提供可供操 作 的指南,尤其没有明确赔偿的方式和来源;对于不动产登记的程序也缺 乏一部相应的程序法来进行规范;尤其最重要的,被称为问题的症结所在 的统一的不动产登记机关的缺失,在这次的物权法中被刻意回避了,导致 了相当多的改革力度并不显著。针对这种情况,建议在不动产登记制度完 善的过程中,应建立不动产物权登记的统一立法以改变我国现行的不动产 登记制度分散,零乱,不健全的现状;加强信息化建设,从根本上摒弃信 息行政专有的传统思维;建立统一的不动产登记程序法,协调各个方面的 利益,使得不动产登记的功效性得以最大限度的发挥;最重要的是建立统 一的不动产登记机关,以公证机关作为登记主体机关,从人员素质,公信 力,公正性各个方面保障登记的准确性,并通过建立赔偿基金的模式,真 正确立登记机关的无过错完全赔偿责任制度,从而实现不动产登记的统 一。

  • The promulgation of the Property Law has filled the blank in legislation for immovable estate and solved the issue on the force of registration of immovable estate. However, due to the historical circumstances, for the sake of the balance of interest of various competent government agencies and based on the technical consideration in legislation, the Property Law has not settled the main problems in the registration of immovable estate in our country once and for all. In effect, the Property Law has not taken the lead after its implementation with a fairly amount of related regulations still in force for the original purpose, and the legislative inconsistency in yet to be resolved. The certificates for ownership have not been unified, making it difficult for the obligee to exercise relevant rights. The search for information is inconvenient with frequent mistakes and has adverse impact on the public confidence of the registration of immovable estate. With regard to the deficiencies in registration as a result of the mistakes of the registration agency of immovable estate, relative laws including the Property Law has not provided operative guidance to ensure the relief and interest of the obligee. In particular, they have not specified the manner and source for compensation. In addition, there is lack of corresponding procedural law in dealing with registration of immovable property. And the issue of the lack of unified agency for the registration of immovable estate, which is viewed as the nexus for all problems, is deliberately eluded in the Property Law. Consequently, quite a few reforms have not been in full play. In relation to the above mentioned situation, it is proposed that a unified legislation for the registration of the right of immovable estate be established to improve the current scattered and immature registration system of immovable property. And the informatization construction is to be enhanced to fundamentally withdraw from the traditional thought in information-based government. Besides, a unified procedural law for the registration of immovable estate is recommended to be established to coordinate the interest of various departments and to maximize the effect of the registration of immovable property. In summary,it is viewed to be of utmost importance to introduce unified agency for theregistration of immovable estate with the notary agency to be the main registration agency. And the precision of registration is to be guaranteed in the quality of the registration staff, the public confidence of registration and the fairness of registration itself. And a compensation fund is to be founded to realize no -fault liability absolute compensation by registration agency and to accomplish unified registration of immovable estate.
