建设工程行业在我国的各个行业部门中占着举足轻重的地位,在这一 行业中,随着行业的发展,出现了一些新的法律问题,如劳务分包,工程 转包以及违法分包。实践中,劳务分包模式也逐渐扩大,但是却没有建立 起真正而完善的建设工程劳务分包制度,劳务分包制度在理论界还是实务 界探讨得很少。本文 笔者竭力从各方面探讨建设工程劳务分包合同制度。 全文除引论和结束语外,共分五部分。 第一部分从四个方面对建设工程劳务分包合同作了概述。首先,界定 出建设工程劳务分包合同的概念;其次,归纳出概念后,分析了劳务分包 合同的法律属性,确定了劳务分包的法律地位,是一种合法的工程施工承 包方式;第三,分析了建设工程劳务分包的法律特征,认为劳务分包是在 工程施工合同之下的从合同,它们之间的关系是企业与企业之间的平等法 律关系;最后,重点阐述劳务分包合同与其他几种合同的区别,以便在司 法实践中能真正分清劳务分包关系,不与其它一些法律关 系混淆。 第二部分简要分析了建设工程劳务分包合同的法律关系,根据民事法 律关系的内容,具体对劳务分包合同的主体、内容、和双方当事人的权利 义务予以剖析,也明确了劳务分包人和工程承包人在合同中应当履行各自 的职责。 第三部分具体分析了劳务分包合同中双方当事人不履行自己的职责, 必将承担相应的法律责任即违约责任。探讨了常见的违约行为以及违约责 任的承担方式。同时也阐述了违约责任的免除和对无效合同的处理。 第四部分分析的我国建设工程劳务分包的现状与存在的问题。建筑业 市场劳务用工队伍极为混乱,队伍庞大而松散,一些包工头用工方 式充次 着用工市场,加之建筑业中农民队伍自身素质和技能较低,容易出现工程 质量问题,建筑工程中劳务现状不容乐观。也分析了产生问题的主要因素, 指出建筑业中存在的问题体现在三方面:第一方面是法律对建设工程劳务 缺乏一个明确的界定,只有一些部门规章和地方性法规进行了界定;第二 方面是劳务分包企业没有形成一套有效的配套、保障措施机制,使得劳务 分包企业难以在激烈的建筑市场发展;第三方面也认为我国建筑业市场监 管力度不大,没有严厉查办违法违规行为。正是由于这些问题,阻碍了劳 务分包企业的良性发展。第五部分对建立和完善建设工程劳务 分包制度提出三点思考。第一, 必须对现实中的建设工程劳务合同纠纷引起重视,并且提出一些预防措 施。第二,必须加强对建设工程施工劳务人员的保护,只有通过对劳务分 包人的保护,才能有利于促进施工劳务企业的培养和发展,进而形成以施 工劳务企业为主流的建设工程施工劳务分包制度。第三,探讨了要建立和 完善劳务分包模式,就要加强劳务用工人员管理,这样能从根本上有利于 确保工程质量和施工安全。对于如何把握用工管理问题也提出了一些合理 化的建议,如必须明确认识劳务分包的本质特征,强化企业劳务资质,健 全劳务人员的管理制度,同时强调劳务分包 必须以劳务为基点。这样能使 我国建设工程劳务分包进入法制轨道,形成完善的建设工程劳务分包制 度。

  • China's construction industry in the various sectors has a pivotal position .This industry will appear in a number of new legal issues, such as subcontracting ser vices, engineering illegal subcontracting, and labor problems in the sub contractors in construction projects Widespread and gradually expanded, but in practice it can not establish a genuine and complete construction of the labor sub system. Services sub sector system in theory or practice of the profession are still new. This article tries from all angles of construction services sub contracts, the author analyses from the construction of the sub contract labor law characteristics, attributes, such as l egal analysis of various aspects. In addition to the full text of Introduction and Conclusion, It is divided into five parts. The first part from the three areas of construction services sub contract the legal characteristics. First, we must define the co nstruction of the concept of sub contract labor services, in order to know what is the construction of labor subcontractors; Second, the construction of the legal services sub features of that labor is in the sub project under the construction contract Fro m the contract, which is the relationship between enterprises and between enterprises equal relationship, bound by such contracts only sub contractors and services between, and letting the people have no legal interest; Finally, the focus of labor Severa l other packages and the difference between the contract, through the analysis that in judicial practice can really distinguish the sub labor relations, not relations with a number of other legal confusion. The second part of a brief analysis of the legal services sub contract attributes. Legal services sub attribute is to determine the legal status of the foundation, the legal status of the labor sub contracting is a legitimate construction contractor, it has the legal attributes of the general characteri stics, namely, the principal, object and content. Analysis of the sub contract labor law attributes, thereby further on the sub contract labor rights and obligations of the parties, labor contractors and their subcontractors to perform the duties agreed in the contract.The third part of sub contracts for the labor contract agreed by the parties in the duties, failing to comply with its obligations certainly have to bear the corresponding legal responsibility. First of all, a legal analysis of the concept of responsibility and duty to determine the construction of the labor contract the parties have to bear responsibility for some of the statutory conditions must be met, otherwise do not bear the legal responsibility and secondly, the construction of a labo r contract that the legal responsibility Problems, the construction of the labor contract law responsibility must be identified by the breach caused. If the two sides agreed breach of contract, breach of relevant laws or regulations, and so will lead to le gal accountability; third, a default on the commitment and responsibility from the issue, the parties must assume the breach of default responsibility, unless there are special agreement; Finally, add Both sides described the illegal labor contract between the sub sub contract labor caused by the problem of invalid. The fourth part of China's construction projects analyses the statu s of the labor sub existing problems. First, we must strengthen the building of the construction workers the protection that only through labor subcontractors for the protection, can help to promote the construction services business training and development, then construction services business to form the mainstream o f the construction project for the construction of the labor Pack system. Secondly, we explore the establishment and improvement of the labor sub model, We need to strengthen labor and employment personnel management, so from the fundamental We ensure th e quality of construction and security. For how to make use of labor management also made some reasonable suggestions, such as sub contractors must be clear to understand of the essential character of labor, strengthen labor qualified enterprises to improv e the labor management system, while stressing that labour sub contractors must be anchored to labor. This enables construct China's legal system into the labor sub contractors, the construction of a perfect labor sub system.
