对基层检察委员会制度的检视 ——以浙江省台州市路桥区人民检察院为主要样板

检察委员会是《人民检察院组织法》规定的检察机关讨论决定重大案 件和其他重大问题的议事和决策机构,是有中国特色检察制度的组成部分。 对于人民检察院检察委员会的有关问题, 虽然有部分学者提出过各种改革 方案,但对司法实践中有其独特功能的基层检察院检察委员会存在的问题 少有论述。本文拟通过对检察委员会的发展与沿革以及浙江省台州市所辖 的各基层检察院检察委员会运行现状与问题的考察,以台州市路桥区人民 检察为主要样板,在深入分析现状、弊端的基础上,提出检察委员会制度 在当前的中国仍具有相对合理性,并着重从正当程序的角度,进一步提出 改进和加强基层检察委员会工作的方案。 本文共四个部分,正文共约二万三千字。 本文引论部分主要对检察委员会制度的概念、目的作了简单描述。文 章指出,基层检察委员会实际承担了处理大量的重大疑难复杂案件的任务, 但运行现状不容乐观。笔者对基层委员会现状的考察主要运用实证研究方 法。实证资料主要来源于笔者专门进行的调研以及已公开的文献资料。 本文第一部分考察了检察委员会制度的沿革。文章指出,检察委员会 制度的产生与发展大致可分为三个阶段:第一阶段为新中国成立前,检察 委员会作为检察机关的内部权力机构的组织形式最早产生于山东抗日根据 地。第二阶段为1949年至1976年,是检察委员会制度的正式确立与发展时 期。该阶段检委制度的显著特点是检察长具有绝对的权威,此种情况虽在 1954年后有所改观,但仍带有一长制的色彩。第三阶段是1978年人民检察 院恢复重建后至今,系检察委员会制度的再度确立与逐步完善时期。 本文第二部分为以基层检察委员会的运行机制为视角所进行的现状考 察。在深入调研的基础上,围绕人员组成、办事机构、议事规则、运行程 序等四个方面,对浙江省台州市两级检察机关五年来的检察委员会工作开 展情况进行了描述。调研资料主要包括:对9个县市区院相关人员的调查问 卷、访谈、报表数据。同时,文中还运用了大量的图表,以求更为直观明 了地说明问题。 本文第三部分为问题解析,即当前基层检察委员会运行机制中的弊端及 原因分析。文中指出,现行检察委员会委员结构方面的弊端主要表现为: 层次结构不合理,专业人才难介入;知识结构较片面, 合议质量难保证;任职机制不完善,更新激励难进行。现行检察委员会办事机构和人员的弊 端主要表现为:组织协调及业务咨询作用未充分发挥,检察委员会办事机 构及人员设置不统一。检察委员会议事规则的弊端主要表现为:讨论案件 范围不明确;讨论决定重大事项责能界定不明确;例会制度未建立。检察 委员会运行程序的弊端则主要表现为讨论案件仅听汇报,不符合司法亲历 性;检察委员会讨论案件“暗箱操作”,不利于实现司法公正;检察委员 会讨论案件责任难界定;议事效率不高以及执行缺乏监督等五个方面。 本文第四部分是检察委员会制度的改革进路。文章首先对检察委员会 制度的存废问题进行了评述,认为我国检察委员会作为检察机关内设的最 高业务决策机构,它在保证司法公正、弥补个人素质的不足和实现内部监 督机制方面所发挥的积极作用是值得肯定的。笔者围绕前文所考察及分析 的四个方面,提出了如何改革与完善检察委员会制度的方案。一是改善基 层院检察委员会人员结构。主要是完善任职机制、培训机制,建立列席制 度。二是健全检察委员会办事机构和人员配置, 加强办事机构职能。首先, 规范检察委员会办事机构设置,力求统一化和专业化。其次,设立专职委 员,确保其履职到位。笔者对专职委员的主要职责、权力以及相关问题提 出了自己的构想。三是健全基层检察委员会议事规则。要明确检察委员会 的定位,理顺检察委员会与院党组、检察长办公会、院务会、检察长、主 诉检察官上下级检察委员会四种关系;加强、规范检察委员会讨论决定“重 大问题”的议事职能;严格界定讨论重大案件的范围;建立检察委员会成 员在议事议案中的法律责任制度。四是规范检察委员会运作程序。主要是 要从议案提请、会前审查、案件讨论、决策、执行程序五个方面进行规范。

  • The Procuratorial Commission (hereinafter referred to as the PC) is an integral part of the prosecution system with Chinese characteristics provided by the 《Organic Law of the People's Procuratorate》,to discuss the major cases and other major issues of procedure. Although some scholars have put forward various reforms about the People's Procuratorate of the Committee on, but few discussed the particular function of the judicial practice of the lowest Procuratorial Commission. In the article, to be adopted by the Commission on the prosecution, as well as the development and evolution of Taizhou in Zhejiang Province under the jurisdiction of the lowest Procuratorial Commission with the issue of the status quo of the study, to the people of Taizhou, Lu Qiao lowest Procuratorial Commission for the main model, in-depth analysis of the status quo, on the basis of the defects , The author proposed the further improvement and strengthening of lowest Procuratorial Commission work of the Commission by the prosecution in the current system of China is still relatively reasonable, and focus on due process from the point of view. The article points out that lowest Procuratorial Commission actually took a lot of major problems to deal with complex cases, but running the status quo is not optimistic. The author used the empirical research methods. Empirical data from the main author, as well as specialized research has been carried out in the open literature. The first part of article the prosecution investigated the origin of the committee system and history. The article pointed out that the PC have a system and development can be divided into three phases: the first phase of the new China was founded before the PC as the prosecution's internal power structure was first produced in Shandong in the form of anti-Japanese base areas. The second stage is from 1949 to 1976, the PC was established with the formal system development. The prosecution phase of the committee system is characterized by a significant Attorney-General has absolute authority, although in this case in 1954 after some improvement, but still with a long-colors. The second part of the article reviewed the operating mechanism from the perspective of the status quo to the lowest Procuratorial Commission. The fourth part is about the reform of the approach roads. I focus on the earlier study and analysis of the four, on how to reform and perfect the system of PC. First, the grass-roots level to improve the hospital staff procuratorial committee structure.
