街道办事处制度是极具中国特色的基层政权制度,《街道办事处组织 条例》是新中国最简单(全文共 7 条)、最稳定而且是有效期最长(1954 年制定至今未作修改)的现行法律,街道办事处制度已成为具有中国特色 的基本政治制度之一。 本文通过笔者在广州市所辖街道办事处当国家公务员的切身体会,对 照国家有关法律法规和地方性政府规章,介绍了与街道办事处制度相关的 主要法规性规定、设立街道办事处的法定依据以及广东省对设立街道办事 处的量化指标要求,以广州市为例说明街道办事处的“三定”(机构、职能、 人员)安排以及经费预算的情况,并回顾了街道办事处职能从建国初期初 创、到法制化、公社化、严重受挫到今天改革探索的转变历程。目前街道 办事处制度运行中条块分割、有责无权,决策权与管理权脱节、工作无计 划、任务繁多的现象突出,存在严重的职能越位、关系错位,与社会主义 市场经济条件下现代城市管理要求不相适应的问题。街道办事处已发展成 一级“准政府”,与政府派出机关名不副实,相关法律法规建设严重滞后, 街道工作陷入无法可依的困境,相关制度亟需改革。 事实上,从上世纪 90 年代上海市开始推行强化街道办事处职能的“两 级政府,三级管理”的城市管理体制后,全国各地城市对如何依法发挥街 道办事处的作用,进行了不少的探索,大体有强化街道办事处职能或撤销 街道办事处两种做法,但都没有形成主流。学术界对街道办事处制度改革 方面的研究也不多,更没有引起立法部门的重视。本文介绍了上海、广州、 北京、武汉、青岛等几个对街道办事处制度改革有一定代表性的城市的模 式,并分析其相关法律问题。最后,结合美国、澳大利亚和新西兰、新加 坡等国家相关城市管理的经验,试图找出对我国转变政府职能,改革街道 办事处制度有益的启示,探讨了街道办事处制度改革的方向。

  • The streets office institution is the basic-level political power institution with typical Chinese characteristic. "Streets Office Organic Rules" is the current law,which is the simplest (full text altogether 7 items), most stablest ,and longest duration of validity (formulated in 1954 and non-revised till now) law in the P.R.C. This institution has become one of basic political institution with Chinese characteristic The author pass his first-hand experience that works as a civil servant in one of the streets office in Guangzhou. By comparing the country relevant laws and regulations , the local government rules and regulations, this paper introduces the main correlation stipulations about the streets office institution, the legal basis of setting up the streets office,as well as the quantification target request to sets up the street office in Guangdong Province. Taking Guangzhou as the example to explain the arrangement of “three decisions” (including organization, function, personnel) in the streets office and the funds budget.The transformation procedure of the streets office is reviewed from its foundation in the early period of the new nation,legalization,communalization, terrible defeated to the reformatory explorer now. At present, the streets office institution is facing many problems such as the division of vertical streets , with responsibility but without right, the separation of the decision-making power and management power, no plan in the street works,the arduous more tasks, having developed one "quasi-government organization",unworthy of the title of the government agency. There is serious functional offside and relational dislocation in the streets office, which is incompatible with the demands of modern urban management under the socialist market economy condition .The construction of related laws and regulations is serious lagging,leading to the streets work falling into the difficult position without any laws to depend on. The streets office institution needs reform. In fact, from the 1990s the city management system had been carried out to strengthen the streets office functions of the"two-level governments, three-level management" in Shanghai.Some explorers have been performed onhow to legally improve the the streets office function in cities throughout the country. There is little study on the reformation of the streets office institution done by the academic community.The main two ways are to strengthen the streets office function or cancell the streets office ,but these perspectives have not been form the mainstream and haven’t attacted the attention of legislative department .In the paper,several urban patterns of the representatative cities on the streets offices institution reform in Shanghai, Guangzhou, Beijing, Wuhan, Qingdao and so on are introduced in the paper.And the related legal issues are analyzed.The experiences of the urban management in some countries such as US, Australia and New Zealand, Singapore and so on are simply described, involving the suggests on the transformation of government functions and the reformation of the streets offices institution for our government.And the trend of the streets office institution reform is also discussed.
