摘要:

根据《刑事诉讼法》及相关司法解释的规定,国家财产、集体财产因 犯罪行为遭受损失,而受损失的单位未提起附带民事诉讼的,检察机关在 提起公诉 时 ,可以提起附带民事诉讼。这即赋予了检察机关提起附带民事 诉讼的权利。本文从检察机关提起附带民事诉讼的意义,当前法律制度下 存在的若干问题, 以及未来检察机关提起附带民事诉讼制度的发展趋势等 方面进行了探讨。 本文第一部分从分析检察机关提起附带民事诉讼的意义 着 手,指出检 察机关提起附带民事诉讼具有三 个方面的 重要意义: 保障国家财产利益和社会公共利益受到侵害后得到有效救济;达到社会效益最大化;符合当代诉权理论发展方向与世界各国的司法实践。以此揭示在我国以公有制为主体的社会主义市场经济体系下,检察机关提起附带民事诉讼对于保护国家财产和社会公共利益的作用。 本文第二部分在现行法律制度下对检察机关提起附带民事诉讼的相关问题进行了探讨,并提出笔者的看法和建议:明确检察机关提起附带民事诉讼的范围;区分是否存在受害单位,受害单位是否提起附带民事诉讼等不同情况,对检察机关提起附带民事诉讼设置前置程序;明确检察机关在提起附带民事诉讼的程序中处于民事原告人的诉讼地位,但不是实体上的原告人;检察机关提起附带民事诉讼,其实体权益的最后归属应当判决收归国库所有;附带民事诉讼的诉讼时效应当与一般民事诉讼相区别适用,此外还对检察机关提起附带民事诉讼案件的法律适用以及判决的执行问题进行了分析,提出了建议。 本文第三部分对检察机关提起附带民事诉讼这一制度在新的社会时期的发展进行了思考,并提出这一制度仍然应当保留,但应对其起诉范围、条件及程序予以调整和完善的思路。在此部分,笔者从检察机关提起附带民事诉讼的合理性与必要性两方面论证了其应当予以保留,但应将集体财产受损的案件排除于检察机关提起刑事附带民事诉讼的范围之外,同时纳入社会公共利益受损的案件,并扩大检察机关可提起附带民事诉讼的损失范围,并不仅限于因财物被毁坏这一种情形,而应适用民事侵权赔偿的相关法律规定,将附带民事诉讼的标的范围确定为“赔偿损失”。同时,还应完善相关程序规定,细化检察机关提起附带民事诉讼的操作规程,并确立 2 检察机关对受害单位的督促机制。此外,提出了在反腐败领域和公益诉讼领域,对某些符合特定条件的案件可以对刑事案件的依附性,赋予检察机关独立提起民事诉讼的权利。

  • According to the states in the criminal procedural law and the relevant judicial interpretations, if the state s properties, the collectiv e properties was damaged by the crimes and the custodial unit does not accuse and raise the additional civil litigant at the same time, the inspecting authorities should prosecute and may raise the additional civil litigant. A ll these articles provide the right of the additional civil litigant to the inspecting authorities . S o this dissertation is exploring the several question s of the current legal system and the trends of the development of the additional civil procedural system in future under the meanin g of these litigants T he first part in the text indicates that the authorities significant meanings to raise the procedure of the additional civil sues in three major aspects under the level of this duty: one is to secure the interests of the state s pro perties and the social public interest that could be relieved after the damages; two is to achieve the maximum of the social effectiveness; three is to cater the developing direction of the procedural rights in today and the judicial practices around the w orld. A ll above discover that the functions of the additional sues by the inspective authorities to secure the state properties and the public interests under the socialism market economic system based on the state owned ones. T he second part is discussing about the relative questions over the additional sues by the inspectors under the current legal systems with the author s opinions and suggestions which are including the following issues: the certain domain of the additional sues of the inspectors; the d ifferences between the existences of the custodial units and the raising of the custodial units which is the prior procedure for the inspectors; the certain positions of the inspectors as the plaintiff s but not as the real one that the objective benefits w ould finally belong to the national treasure in the civil sues in the additional civil procedure; the different expirations in the two civil procedures and additionally the analysis and suggestions about the legal applications and the 2 executions of the jud executions of the judgments by the gments by the additionaladditional civil sues.civil sues.
