、审查认定权、处罚决定权和处罚执行权,而在同样以国家权力为背景的刑事案件中,这些权力分属公安机关、检察机关和人民法院行使,其集权与分权制衡的优劣显而易见;加之行政程序运行封闭性造成的信息不对称状态,对行政处罚程序的有效监督、对当事人的及时救济始终是学界和实务界关注的焦点之一。目前,对行政处罚程序的监督和对当事人的救济主要通过听证、复议、行政诉讼等程序实现,这些程序的启动无一不以当事人的申请为前提,参与程序的“兴趣”则是提出申请的根本动机;当事人是否能进行有效的陈述、申辩和抗辩,则是监督程序和救济功能能否发挥作用的基本保证。只有来自基于利益冲突的不同立场的、在程序权力上平等、能力相当的对抗,才是真正的对抗,这样的对抗才是对行政程序最有效的监督,当事人才能实施有效的自救。行政告知则是为实现此“兴趣”和有效对抗的重要制度设计和保障;同时,告知通过建立平等、自主的交流平台,体现了对当事人人格的尊重和程序关怀,使当事人,及至公众更易相信并接受处罚程序的公正性和权威性。 本文基于重庆市农业行政处罚的视角,以《行政处罚法》、《行政诉讼法》、司法解释,以及农业部有关规章为依据,结合实际工作,尝试对农业行政处罚程序告知制度进行研究,以厘清其现状和不足,并提出建议。本文分5个部分,17500字: 在导言部分,笔者阐述了尝试以告知制度的研究,就完善农业行政处罚程序告知制度、提高执法人员程序公正意识和务实操作能力提出建议,以实现行政处罚程序保障当事人权益的根本价值之初衷。 第一部分,通过《行政处罚法》、《行政诉讼法》、有关司法解释和农业部有关规章的比较,结合重庆市农业行政执法实践,尝试对农业行政处罚程序中告知制度和实务操作的现状和不足展开分析。 第二部分,在界定告知概念的基础上,基于“自然公正原则”的要求,论述了告知制度的价值取向;论述了告知制度在保障信息对称、推进行政程序运行、规制行为、保护当事人人格尊严与程序权利、实现案卷排它原则等方面的作用;基于行政处罚程序集权、封闭的特点,以及行政公正、公开的要求,阐述了完善告知制度的必要性;分析告知制度与其他行政程 2 序法基本制度的联系和区别。 第三部分,基于程序公正的目的,从以下几方面对告知的内容、方式和标准进行论述:行政处罚程序告知的内容,不是证据、法规的罗列,而是“心证”的公开,告知是行政机关履行说服责任的过程;行政机关告知送达的方式、途径;行政处罚程序告知的对象,不仅是当事人,也应包括普通公众,告知的内容应能说服具有一般理性、经验和正确逻辑思维的人,是行政机关维护社会正义的体现;行政机关履行告知的标准有内容完整、时限及时、逻辑清楚等;告知行为违反法定程序或程序瑕疵的法律责任。 第四部分,尝试就如何完善农业行政处罚告知制度、提高实务水平提出建议。完善制度,从完备告知内容、确定告知标准和建立瑕疵补正规则三个方面提出建议;提高执法人员素质、技能,从树立程序的实质意识、树立当事人角度的公正意识,树立程序关怀的服务意识、建立对效率与公正的正确认识等方面提出建议。

  • During the procedure of administrative punishment, which is labeled as ‘autocratic’, the administrative body exercises the power of investigation and evidence-collection, the power of examination and determination and that of penalty decision, while during the procedure of criminal punishment, these three powers are exercised separately by public security bureaus, procurator organs and people’s courts of law. Moreover, because of the unsymmetrical caused by the informational obscuration in the administrative procedure, the supervision on it and due remedy to the clients becomes the focus of the juristic circle, which currently are realized through hearings, reviews and administrative proceedings. The three procedures are triggered by the clients’ application, which in turn is motivated by their interests in taking part in the procedure. Whether the clients can effectively represent and defend themselves is the key to the success of the supervision on the procedure and remedy to the clients. Only when the antagonistic action is based on the different position resulting from conflicts of interest and the equal rights shared during the procedure, is there a true confrontation. This kind of confrontation in effect is the most effective supervision on the administrative procedure. And with the shared equal rights and proper adversary capability clients can perform effective self-saving function. Therefore, the notification system is designed to ensure the clients’ interest and their effective confrontation. At the same time, the system is founded on the basis of equal and independent communication between the clients and administration, which represents the respect and caring for the client’s dignity. This will lead to the public’s belief in the justice and authority of the punishment. The essay tends to study the notification system of agricultural administrative procedure on the basis of the administrative penalties law, the administrative law, the judicial interpretation and the related regulations laid down by the Department of Agriculture. It tends to depict 2 the current state of the system and point out the deficiency. There are 5 parts included in the essay with 17500 words. In the introduction, the writer shows the original intention to perfect the system and raise the executors’ awareness of due course by giving proper advice. Part 1. The essay tends to analyze the current state and the deficiency of the system by comparing the administrative penalties law, the administrative procedure law and the judicial interpretation with the related regulation of the Department of Agriculture on the basis of the enforcement of the Chongqing agriculture law. Part 2. The essay will explain the ethical principle orientation of the system by following the requirement of the principle of natural justice. And it will emphasize the importance of keeping the symmetry of the information to promote the smoothness of the procedure, restrict people’s deeds, protect the dignity of the clients and their procedural rights and realize the principle of files exclusiveness. Based on the requirement of the fairness and publicity and the autocratic features of the procedure, the essay emphasizes the necessity to perfect the system. Part 3. The essay aims at justice, explores the content, methods and standard of notification. This paper makes it clear that the content is not only the demonstration of evidence and related laws and regulations, but also the publicity of discretional evaluation; additionally, the content of notification should be accepted by the people having related reason, experience and appropriate logic; it also clarifies that the targets of the administrative penalties notification is not just the party accused, but also the public; apart from that, it also makes clear that the standard of notification should be complete, prompt, and clear. Part 4. The essay puts forward some suggestions on how to perfect the agricultural administrative penalties procedures and improve its practice from three aspects: improving the content of notification, setting standards of notification and making error-correction regulations. This paper also emphasizes the significance of improving the qualifications,law-enforcement abilities of the law-enforcement officials and the significance of the justice-awareness of the party accused, the service-awareness of the judicial procedure, and proper recognition to the relationship between efficiency and justice.
