刑事侦查是指公安机关在刑事案件中为了查明犯罪人、收集固定证据、确定犯罪事实的而进行的各种活动。由于侦查活动的启动通常晚于刑事案件的发生，因此上它是一种从已知到未知，追根溯源重现犯罪及犯罪活动的间接认知过程。而如何从已知的信息获得未知的案情?那就是要在这种认知过程中必须有逻辑的介入和操作。侦查和逻辑的之间的关系从来就非常密切。刑事案件侦查虽然外在表现为各种形式的侦查活动，但从本质上讲它总是一个自觉或不自觉的情况下依靠逻辑规律进行推理和判断的逻辑思维过程。从这个意义上来讲，侦查过程在刑事案件中的也体现为一种思维过程，这种思维过程就是溯源、推导的过程，并且这个过程必须借助于逻辑推理这种形式来完成。逻辑推理是对案件情况正确地进行分析和推断的必然途径，在刑事案件侦查中它具有不可替代的重要地位。当前我国社会正处于经济转轨、社会转型，以及刑事犯罪高发、各种利益主体之间冲突加剧矛，社会盾凸的严峻状态下。一方面，刑事犯罪案件呈高发态势这一情况还将在较长时间内存在，犯罪的有组织化、暴力化、低龄化、智能化趋势越来越明显。犯罪形式的不断多样化和犯罪手段的快速升级迫切要求我们要把握新形式下刑事犯罪的规律和特点，努力强化打击和预防刑事犯罪的针对性和时效性。另一方面，随着法治建设的进步和社会主义法制理念贯彻落实，法治意识和权利意识普遍深入人心，司法机关对于办案质量的要求也越来越高。在此情况下,如何有效地推进侦查破案工作和提高办案案质量，逻辑推理在其中发挥着重要的作用。纵观多年来的实践，凡是逻辑推理得当就能有效找准案件的突破口，使案件在短时间得以破获；凡是逻辑推理严密，证据运用符合证明标准，就不会发生错案。本文作者在写作过程中借鉴了有关法律逻辑学和刑事侦查学的论著并结合自身的刑侦工作实践，提出了逻辑推理在刑事侦查中是多种推理形式的综合运用的观点。本文分导言、基本内容和结语三部分内容。其中基本内容是文章的主体部分。导言简要介绍了逻辑学和逻辑推理的基本概念及其与在刑事侦查工作中的重要意义,对当前侦查逻辑学的研究状况进行了回顾总结.基本内容分五部分:第一部 3 分论述了刑事侦查工作中运用逻辑推理的必要性;第二部分论述了刑事侦查工作中进行逻辑推理的方法;第三部分分析了正确进行逻辑推理的基本条件;第四部分对侦查工作中进行逻辑推理时应注意的问题进行了探讨,结语部分对于逻辑推理在刑事侦查工作中的作用进行了总结,提出了逻辑推理在刑事侦查中的运用实际上是多种推理形式的综合运用并集中体现于侦查假说中的观点。

The criminal detection is mainly refers to the Public security organ to verify the perpetrator who, the collection evidence, determination delinquent account each activity carries on the criminal case. Because detection will be occurs at the case later only then starts, therefore it will be in essence one kind from known to unknown, will get to the bottom the reappearance crime and will criminal activity's indirect learning process, in this kind of learning process, how obtain the unknown case from the known information, then must have the logical operation and the involvement. The detection and the logical relations are very always close, detection process always aware or not on own initiative carries on the inference and the judgment logical thinking process using the logical rule. In a sense, the case investigates the process is also one kind of thinking process. This kind of thinking process is the backward, pushes lun the process, must draw support in certain logic reasoning form completes, the correct logic reasoning is carries on the correct analysis, the effective inference necessary tool to the case. The logic reasoning in the case investigates has the unreplaceable influential role. The current our country society is being in the economical switch, social reforming, as well as criminal offense succeeding in the imperial civil service examinations, the contradictions among the people highlight, the struggle complex and so on under the austere situation. On the one hand the criminal offense succeeding in the imperial civil service examinations situation will also exist in the long time, the crime violence, the organization, the intellectualization, the low age tendency highlight day by day. The crime form changes and the crime method unceasing diverse urgent need unceasingly we must hold under the new form the crime rule characteristic, the practical enhancement prevents and cracks down on the crime the effectiveness and pointed. On the other hand, implements and realizes along with the government by law construction's progress and the socialist legal system idea, government by law consciousness and right consciousness strike root in the hearts of the people generally, the Judicial organ is also getting higher and higher 2 regarding the handling a case quality's request. How therefore to advance the detection investigation to work and to enhance effectively handles a case the document quality, the logic reasoning is playing the vital role. The holoscopic for many years practice, every logic reasoning appropriate has been able to look for the accurate case's breach effectively, enables the case to uncover in the short time; Every logic reasoning is strict, the evidence utilization conforms to the proof standard, will not have the misjudged law case. This article author has profited from the relevant law logic and the criminal detection study in the writing process is discussing and unifies own criminal investigation working practice, proposed the logic reasoning in the criminal detection is many kinds of inference form synthesis utilization viewpoint. This article is divided the introduction, the basic content and the conclusion three partial contents. And the basic content is the article main body part. the introduction introduced briefly the logic and logic reasoning's basic concept and with in the criminal detection work's important meaning, has carried on the review summary to the current detection logic's research condition. The basic content is divided five parts: The first part elaborated in the criminal detection work to utilize the logic reasoning the necessity; The second part elaborated in the criminal detection work to carry on the logic reasoning the method to use; The third part analyzed has carried on the logic reasoning correctly the basic condition; The question which the fourth part to investigates in the work to carry on when logic reasoning should pay attention to carry on the discussion, the conclusion part regarding the logic reasoning in the criminal detection work function has carried on the summary, proposed the logic reasoning in fact was many kinds of inference form synthesis utilizes in the criminal detection's utilization and concentrates manifests in the detection hypothesis the viewpoint.
