本篇翻译报告是基于《法律导论》第五章英译汉这一翻译项目而来。该章重点介绍了英国与财产有关的法律制度的渊源及财产权利的演变，从法律与土地的关系入手，详尽地阐述了英国财产法的由来和发展，能让读者充分了解英国资本主义社会下的立法渊源,旨在帮助目标语言读者充分了解英国这一典型的普通法国家土地相关立法的情况，有助于丰富我国在普通法国家土地相关权利和立法方面的知识储备，并帮助我国更好地处理相关国际法律问题。笔者选取以尤金·奈达的功能对等理论作为本篇翻译报告的指导理论，通过对源文本特点的分析，采用多种技巧对选自源文本的十八个案例进行分析和翻译，其中法律术语翻译主要运用直译、增译和转换，长句翻译主要运用拆译、倒序、包孕技巧，并重点探讨其中的法律术语和英语长句的翻译难点。在整个翻译实践中，笔者尝试将理论其与翻译实践相结合，探讨法律文本的翻译技巧，希望在提高自身翻译能力的同时,也为其他译者在翻译同类型的文本时提供一些翻译思路和启示。

  • This translation report is based on a translation project, through which Chapter 5 of the book, An Introduction to Law (the Source Text), was translated from English to Chinese. The chapter focuses on the origin of the property-related legal system and the evolution of property rights in the UK, as well as the relationship between law and land. The chapter begins with an exhaustive account of the origin and development of property law in the UK. The target language text is intended to help target language readers to fully understand the origin of land-related legislation in the UK, a typical common law jurisdiction, and may therefore contribute to enriching China’s knowledge stockpile on land-related rights and legislation in common law countries, and helping China better deal with relevant legal issues. The author adopts Eugene Nida’s Functional Equivalence as the guiding theory for this report. Analyzing the characteristics of the source text, some cases selected from the source text are analyzed and translated by various translation techniques. Literal translation, Amplification and Conversion are mainly used in the translation of legal terms while Division, Inversion and Embedding are mainly used in the translation of long sentences, and the author focuses on exploring the difficulties in translating the legal terminology and the long sentences in English. The author tries to combine the theory with the translation practice to explore the translation skills of legal texts, hoping to improve the translation ability and provide some translation ideas and inspiration for other translators when translating similar types of legal texts.
