本文是一篇基于How the Law Works(《法律是如何运作的》)第六章翻译实践项目写成的翻译报告。《法律是如何运作的》是一部介绍普通法系的法学著作,其中第六章着重介绍英美法律体制中议会法案的相关知识。本报告对源文本进行了简要分析,描述了翻译过程,并根据英汉语言之间的五大差异,即形合与意合、静态与动态、被动与主动、繁复与简洁、非人称与人称,探讨源文本中连接词、人称代词、名物化、介词、被动句、复杂句、无灵主语句的翻译问题,并提出相应的翻译技巧:采用省译法、保留法和增补法翻译连接词;采用省译法、重复法和保留法翻译人称代词;采用转换法和保留法翻译名物化和介词;采用语态转化法和语态保留法翻译被动句;采用拆译法翻译复杂句;采用增补法和保留法翻译无灵主语句。本报告可为基于语言差异探讨学术著作翻译问题提供参考。

  • This is a report based on the translation of Chapter 6 of How the Law Works, a legal scholarly writing that introduces the common law system, of which the sixth chapter focuses on the acts of parliament in the Anglo-American legal system. This report briefly analyzes the source text and describes the translation process. Based on five major differences between the English and Chinese languages, namely, hypotactic vs. paratactic, static vs. dynamic, passive vs. active, complex vs. simplex, and impersonal vs. personal, it discusses the translation of conjunctions, personal references, nominalizations, prepositions, passive sentences, complex sentences and inanimate-subject sentences in the source text, and puts forward different translation skills, namely, omission, retention and addition for the translation of conjunctions; omission, repetition and retention for the translation of personal references; conversion and retention for the translation of both nominalizations and prepositions; voice change and voice retention for the translation of passive sentences; splitting for the translation of complex sentences; and addition and retention for the translation of inanimate-subject sentences. This report can hopefully provide reference for exploration and discussion of academic translation based on linguistic differences.
