金融科技创新推动金融市场蓬勃发展,在科技手段的加持下,开放银行蕴育而生,新兴的开放型商业模式就此形成。开放银行模式下,银行利用以API为主的金融科技手段,将收集储存的个人数据与第三方机构进行共享,从而为个人客户提供更多的金融产品和金融服务。开放银行的发展在英国、美国、澳大利亚、新加坡等国家已经较为成熟,各国也制定了一系列的监管政策以支持、激励和引导开放银行的发展。但我国的开放银行市场正处于发展的初级阶段,开放银行各参与主体也还在积极探索更完善安全的个人数据共享模式。在此背景下,机遇与挑战并存,日新月异的金融科技在创造更多可能性的同时也为金融监管带来了新的挑战。目前,我国针对开放银行模式下个人数据共享的监管机制尚有不足之处,即传统的监管机制已然不能完全应对开放银行模式下个人数据共享产生的金融风险,个人的数据权益也面临巨大的威胁。因此,为了助力我国开放银行的健康发展,并在充分保障个人数据权益的基础上推动个人数据的共享,以挖掘更多的个人数据价值,有必要进一步完善我国开放银行模式下个人数据共享的监管机制。本文除引言和结语之外分为三个部分:第一部分为开放银行模式下个人数据共享的监管机制概述。本部分首先对开放银行模式下个人数据共享的概念、共享模式及特点进行介绍。其次阐释了构建开放银行模式下个人数据共享的监管机制的基础理论,其中具体分析了构建开放银行模式下个人数据共享监管机制的理论证成,还探讨了构建开放银行模式下个人数据共享的监管机制应遵循的基本原则。最后分析了完善开放银行模式下个人数据共享监管机制的现实需要,即助力开放银行发展的需要、保护个人数据权益的需要、维护金融市场秩序的需要。第二部分为开放银行模式下个人数据共享监管机制的问题检视。本部分通过对开放银行模式下个人数据共享的现有监管机制进行梳理和分析,分别阐述了开放银行模式下个人数据共享的监管机制在监管主体、监管标准、监管方式三个方面所存在的问题。首先,针对开放银行模式下个人数据共享的监管主体存在的问题,主要从政府监管机制不完善和行业自律机制不健全等方面对其进行了阐述。其次,针对开放银行模式下个人数据共享的监管标准存在的问题,主要从第三方机构准入标准不完善、个人数据共享范围标准不明确、API技术标准不完善等方面对其进行了阐述。最后,针对开放银行模式下个人数据共享的监管方式存在的问题,主要从监管协调机制不健全、监管科技手段不完善、监管沙盒机制不完善等方面对其进行了阐述。第三部分为开放银行模式下个人数据共享监管机制的问题应对。本部分针对梳理出的我国开放银行模式下个人数据共享的监管机制所存在的问题,在对域外相关监管经验借鉴的基础上,结合我国开放银行模式下个人数据共享业务的实际应用情况,分别从监管主体、监管标准和监管方式三个层面提出对我国开放银行模式下个人数据共享的监管机制的问题应对措施。首先,关于开放银行模式下个人数据共享的监管主体问题的应对,主要从完善政府监管机制和健全行业自律机制等方面对其进行了阐述。其次,关于开放银行模式下个人数据共享的监管标准问题的应对,主要从完善第三方机构准入标准、明确个人数据共享范围标准、完善API技术标准等方面对其进行了阐述。最后,关于开放银行模式下个人数据共享的监管方式问题的应对,主要从健全监管协调机制、完善科技赋能监管机制,完善监管沙盒机制等方面对其进行了阐述。

  • Financial innovations is driving the development of the financial market, and with the support of technological means, open banking has been born and an emerging open business model has been formed. Under the open banking model, banks utilize API-based financial means to share the collected and stored personal data with third-party organizations, so as to provide more financial products and financial services for individual customers. The development of open banking has become more mature in countries such as the United Kingdom, the United States, Australia and Singapore, and each country has formulated a series of regulatory policies to support, incentivize and guide the development of open banking. However, China's open banking market is in the early stage of development, and the various participants in open banking are still actively exploring a better and safer personal data sharing model. Against this background, opportunities and challenges coexist, and the ever-changing financial creates more possibilities while also bringing new challenges to financial regulation. At present, China's regulatory mechanism for personal data sharing under the open banking model is still insufficient, i.e., the traditional regulatory mechanism can no longer fully cope with the financial risks arising from personal data sharing under the open banking model, and the rights and interests of individuals' data are facing great threats. Therefore, in order to facilitate the healthy development of China's open banking and promote the sharing of personal data on the basis of fully protecting the rights and interests of personal data, so as to explore more value of personal data, it is necessary to further improve the regulatory mechanism for personal data sharing under China's open banking model.This paper is divided into three sections in addition to the introduction and conclusion:The first part is an overview related to the regulatory mechanism of personal data sharing under the open banking model.This part firstly introduces the concept, sharing mode and characteristics of personal data sharing under the open banking model. Secondly, it explains the basic theory of constructing the regulatory mechanism of personal data sharing under the open banking model, in which the theoretical proof of constructing the regulatory mechanism of personal data sharing under the open banking model is specifically analyzes, and the basic principles that should be followed in constructing the regulatory mechanism of personal data sharing under the open banking model are also discussed. Finally, it analyses the practical needs to improve the regulatory mechanism of personal data sharing under the open banking model, i.e. the need to facilitate the development of open banking, the need to protect the rights and interests of personal data, and the need to maintain the order of the financial market.The second part is a review of the problems of the regulatory mechanism of personal data sharing under the open banking model. By sorting out and analysing the existing regulatory mechanism of personal data sharing under the open banking model, this part elaborates on the problems of the regulatory mechanism of personal data sharing under the open banking model in the three aspects of the regulatory body, regulatory standards and regulatory methods. Firstly, the problems of the regulatory body of personal data sharing under the open banking model are mainly elaborated from the aspects of imperfect governmental regulatory mechanism and unsound industry self-regulatory mechanism. Secondly, the problems of the regulatory standards of personal data sharing under the open banking model are mainly elaborated from the aspects of imperfect access standards of third-party organizations, unclear standards of the scope of personal data sharing, and imperfect technical standards of API. Finally, the problems in the regulatory approach to personal data sharing under the open banking model are mainly elaborated from the aspects of unsound regulatory coordination mechanism, imperfect regulatory technology means, and imperfect regulatory sandbox mechanism.The third part is the response to the problems of the regulatory mechanism of personal data sharing under the open banking model. This part addresses the problems existing in the regulatory mechanism of personal data sharing under the open banking model in China, and on the basis of the relevant regulatory experience in the extra-territorial area, combined with the actual application of the personal data sharing business under the open banking model in China, it proposes responses to the problems of the regulatory mechanism of personal data sharing under the open banking model in China from the three levels of the regulatory main body, the regulatory standard and the regulatory mode. Firstly, the response to the regulatory body of personal data sharing under the open banking model is mainly elaborated from the aspects of perfecting the governmental regulatory mechanism and improving the industry self-regulatory mechanism. Second, the response to the regulatory standards of personal data sharing under the open banking model is mainly elaborated from the aspects of improving the access standards of third-party organisations, clarifying the standards of the scope of personal data sharing, and improving the technical standards of API. Finally, regarding the response to the regulatory approach to personal data sharing under the open banking model, it is mainly elaborated from the aspects of improving the regulatory coordination mechanism, improving the technology-enabled regulatory mechanism, and improving the regulatory sandbox mechanism.
