摘要：

《反外国制裁法》的实施面临着国家安全利益和经济产业利益相互冲突的困境，需要通过豁免机制进行利益衡平。豁免机制是成熟制裁与反制裁机制中的固定组成部分，在解决利益冲突问题、健全反制裁立法体系、实现多重政策目标中具有重要作用。我国《反外国制裁法》中该制度规定的缺失，不利于反制措施的有效实施。欧盟、美国制裁与反制裁立法中都包含了豁免机制，我国可参考其制度经验作出符合中国国情的选择，建立、健全具有可操作性的豁免机制，明确豁免的标准、范围和程序规则。如此，才能有效缓解《反外国制裁法》实施中保护与惩罚的冲突对立，实现安全利益与经济利益的平衡。

  • The implementation of the Anti-Foreign Sanctions Law is confronted with the dilemma of the conflict between the interests of national security and the interests of economic industry, so it is necessary to balance the interests through the exemption mechanism. The exemption mechanism is a fixed part of mature sanctions and counter-sanctions mechanisms, and plays an important role in solving the problem of interest equity, improving the anti-sanctions legislation system and realizing multiple policy objectives. The Anti-Foreign Sanctions Law lacks provisions on this system, which is not conducive to the effective implementation of countermeasures. Bothe EU and US santions and anti-sanctions legislation include exemption mechanisms. China can make a choice in line with China's national conditions by referring to its institutional experience, establish and improve the operational immunity mechanism, clarify the standards of immunity and the procedural rules of immunity, and reasonably balance the opposition relationship between protection and punishment in the implementation of the Anti-Foreign Sanctions Law, to achieve a balance between security interests and economic interests.
