随着国家卓越法治人才教育培养计划2.0的提出,推动法学研究生教育适应党和国家事业发展需要的改革方向日臻明确。法学研究生刑事疑难案例教学模式体现在个案分析到类案办理未延伸疏通、教学内容与办案技能未协调衔接、法理判断与情理关怀未有机统一三方面的实际运行效果,与其应然培养目标之间存在错位与偏差。因此,应当在他山之石与本土经验的共同启发下,确立“真实+练习”的底层逻辑,完善“充分拓展以案释法、以案拓法、以案修法三种案例教学方法,全面培训法律思维能力、案情整理能力、证据分析能力、沟通写作能力四项法律实务技能,完整塑造根植实现良法善治的信念、兼顾常识常理常情的考量两类品格”的要素设计,以顺利实现法学研究生刑事疑难案例教学模式的适应型转向。

  • With the proposal of the National Plan for Educating and Training Outstanding Legal Talents 2.0,the reform direction of promoting postgraduate education in law to meet the needs of the development of the Party and the state has become increasingly clear.There is a dislocation and deviation between the actual operation effect and the training goal of the criminal difficult case teaching mode of law postgraduates,which is embodied in three aspects:the case analysis to the class case handling is not extended,the teaching content and the handling skills are not coordinated,and the legal judgment and rational care are not organically unified.Therefore,it is necessary to establish the underlying logic of "truth+practice" under the inspiration of foreign achievements and local experience,and improve the design of elements,including fully expanding three case teaching methods,namely the interpretation method by case,expanding the method by case and amending the method by case,comprehensive training four legal practice skills,namely legal thinking ability,case sorting ability,evidence analysis ability,communication and writing ability,completely shaping two types of character,namely rooting in the belief of good law and good governance,consideration of common sense and common sense.Thus,the adaptive turn of the teaching mode of criminal difficult cases for law postgraduates is successfully realized.
