党的二十大报告明确提出“支持和规范发展新就业形态”,但综观现有研究范式与制度安排,如何进一步推动并落实新就业形态从业者的劳动权保障,尚无定论。究其缘由,新就业形态中劳动关系认定难俨然成为共识。实际上,新就业形态中劳动关系的认定不是独立问题,也是以往“认定难”的延续和放大,还涉及劳动关系含义、意义和边界的反思,需要置身于新时代我国劳动就业新发展与劳动关系新治理等背景下全面考察。如何破局,需要创新、共识与再共识,整体方略是:从劳动法特殊的价值理念与新时代我国劳动关系的治理需求出发,明确价值指向,奠定认定逻辑。具体措施为:一是要承认劳动关系认定的独立性,二是要完善从属性的认定标准,三是要正确处理当事人合意与客观履行事实之间的关系,四是要构建多层次的权利义务体系。

  • The report of the 20th National Congress of the Communist Party of China clearly proposes to “support and regulate the development of new forms of employment”, but considering the existing research paradigm and institutional arrangement, there is no definite conclusion on how to promote and implement the protection of labor rights in the new employment pattern. The reason is that it has become a consensus that it is difficult to identify labor relationship in the new employment forms. In fact, the identification of labor relationship in the new employment patterns is not an independent issue, but also a continuation and amplification of the previous “difficulty in identification”, and involves a reflection on the meaning, significance and boundary of labor relations. It needs to be examined comprehensively in the context of the new development of employment and the new governance of labor relations in China in the new era. How to break the situation requires innovation, consensus and re-consensus. The overall strategy is to start from the special conceptual value of labor law and the governance needs in China, to clarify the value orientation and to establish the logic of identification. The specific measures are as follows: firstly, to recognize the independence of labor relationship determination; secondly, to improve the subordinate determination criteria; thirdly, to correctly handle the relationship between the parties' agreement and objective performance facts; and fourthly, to build multi-level system of rights and obligations.
