摘要：

宅基地退出中农民权益的保障是中国式现代化在农村实现的重要维度，是推动宅基地集约利用和提升农民获得感的重要抓手。宅基地退出过程中农民权益保障面临宅基地退出法律法规不完备、宅基地退出补偿机制不规范、宅基地退出保障制度不健全、农民利益诉求表达不畅通及农村土地发展权制度不明确等多重困境。基于一种法社会学的分析立场，在中国式现代化视域下建构宅基地退出中农民权益保障的制度图景，其突破点应包括如下五个方面：一是落实农民自治权利保障农民政治权益；二是创新退出补偿制度实现农民财产权益；三是健全农村社会保障制度夯实农民社会权益；四是优化利益诉求机制保障农民法律救济权益；五是共享增值收益分配实现土地发展权益。

  • The protection of peasants rights and interests in the withdrawal of homestead is an important dimension for the realization of Chinese-style modernization in rural areas, an important issue to face in the overall revitalization of rural areas, and an important starting point to promote the in-depth reform of the homestead system and enhance peasants sense of gain.The peasants rights and interests in the withdrawal of homestead have rich connotations and are a relatively typical bundle of rights.Based on the typification of civil rights in Chinas Constitution, the rights and interests of peasants in the process of homestead withdrawal can be summarized as political rights, property rights, social rights, legal relief rights, and land development rights.In summary, the problems faced by the protection of peasants rights and interests during the withdrawal of homestead are as follows: First, the institutional thickness of homestead withdrawal is insufficient; Second, the compensation mechanism for homestead withdrawal is not standardized; The third is that the security system for the withdrawal of homestead is not sound; The fourth is that the expression channels of peasants interest demands are not smooth during the process of homestead withdrawal; Fifth, the system of rural land development rights is unclear.How to protect the peasants rights and interests in the process of homestead withdrawal in the process of promoting Chinese-style modernization needs to start from the overall situation at the operational level, and pay more attention to the system response at the normative construction level.Based on the analytical position of sociology of law, the system prospect of peasants rights and interests protection in the withdrawal of housing base is constructed from the perspective of Chinese path to modernization.Its breakthrough points include: first, the implementation of peasants autonomy rights to protect peasants political rights and interests; Second, innovate the exit compensation system to realize peasants property rights and interests; Third, improve the rural social security system to consolidate the social rights and interests of peasants; Fourth, optimize the interest appeal mechanism to protect peasants legal relief rights and interests; Fifth, sharing value-added income distribution to achieve land development rights and interests.
