摘要：

从当前经济社会发展和刑法自身完善的现实需要，以及全面推进科学立法、提高立法质量的要求来看，有必要对我国《刑法》进行全面纂修，使之成为一部更加符合时代需要、体现中国特色、科学完备、垂范久远的刑法典。刑法典的全面纂修，应积极回应社会治理需要，增强立法的预见性和能动性，贯彻融会贯通的系统思维，遵循回应性、前瞻性和系统性理念，继续坚持统一刑法典模式，对当前“总则编+分则编”式的框架体系进行优化，同时确立轻罪及其配套的前科消灭制度。

  • From the perspective of the current economic and social development and the practical needs for the improvement of the criminal law itself, as well as the requirements of comprehensively promoting scientific legislation and improving the quality of legislation, it is necessary to comprehensively compile the Criminal Law of China, so as to make it a criminal code that is more in line with the needs of the times, reflecting the characteristics of China, scientific and complete, and exemplary for a long time. The comprehensive compilation of the Criminal Code should actively respond to the needs of social governance, enhance the predictability and initiative of legislation, implement the comprehensive system thinking, follow the concepts of responsiveness, foresight, and systematism, continue to adhere to the unified criminal code model, optimize the current framework system of “general principles and sub-principles”, and establish misdemeanor and its supporting criminal record elimination system.
