乡村振兴战略对农村集体经营性建设用地的入市提出了平等式权利保护、交易式效率提升、规划式秩序维护、保障式收益分配、完善式配套建设等需求。针对农村集体经营性建设用地入市存在的主体、客体、交易、分配和配套制度等方面的制度困境，需要以乡村振兴战略的需求为指引进行纾解。在主体方面，需要厘清入市流转主体，统一入市实施主体。在客体方面，需要入市征收妥当分置，充分贯彻经营目的。在交易方面，需要统一入市交易方式，明晰入市交易规则。在分配方面，需要厘清政府与集体之间的外部分配和集体与成员之间的内部分配。在配套制度方面，需要促进土地登记确定化、土地规划科学化和利益保障完善化。

  • The rural revitalization strategy puts forward the requirements of equal right protection,transaction efficiency improvement,programmatic order maintenance,guaranteed income distribution,and perfect supporting facilities construction for the market entry of rural collectively owned profit-oriented construction land. In view of the institutional predicament in the subject,object,transaction,distribution and supporting systems of rural collectively owned profit-oriented construction land entering the market,it is necessary to relieve the predicament based on the needs of the rural revitalization strategy. In terms of subjects,it is necessary to clarify the circulation subjects of entering the market and unify the implementation subjects of entering the market. In terms of objects,it is necessary to properly separate market entry and expropriation,and fully implement the business purpose. In terms of trading,it is necessary to unify the method of entering the market and clarify the rules for entering the market. In terms of distribution,it is necessary to clarify the external distribution between the government and the collective and the internal distribution between the collective and its members. In terms of supporting systems,it is necessary to promote the confirmation of land registration,the scientificization of land planning and the improvement of interest protection.
