人权大致可分为:自由权、参政权、生存权、请求权和平等权。民事诉讼当事人在诉讼进程中应当充分享有上述的基本人权。在民事诉讼中,应保障当事人的自由权能够充分有效地实施;应倡导"官民协商对话"的民主型诉讼模式;在审判程序,特别是执行程序中对生存权加以切实地保护;加强对程序法上的请求权的人权保护;强调对当事人人格尊严的尊重,落实当事人的平等权。

  • Human rights can generally be divided into right of liberty, suffrage, right to exist, petition right and right of equality, all of which should be enjoyed by civil litigation parties in the proceedings. The parties’ freedom must not be hampered and "deliberations between officials and civilians" (a democratic litigation pattern) should be encouraged. Right to exist should be well protected in the trial and especially in the execution of a judgment. Protection should be effectively furnished to the parties’ petition right and respect to parties’ personality and dignity should also be stressed so as to exercise their right of equality.
