当代中国与俄罗斯的婚姻家庭法分别走向了回归民法典与继续保持独立法典化的不同道路。俄罗斯独立家庭法典的巨大制度容量与社会治理模式包容性,使其在应对生育率下滑、人口机构老龄化、核心家庭松弛等社会问题上,形成了独特与有效的调整方法与经验,尤其在兼顾婚姻自由与家庭稳定、追求男女实质平等、落实子女利益最大化原则等方面,形成了相对我国《民法典》"婚姻家庭编"等相关制度体系适用与完善过程的重要参照系。这一参照对于在获得婚姻家庭法因回归民法典而享有一般私法原则与制度滋养之好处的同时,如何防范因失去独立立法模式而可能导致弱化婚姻家庭法区别于财产法的独特伦理性制度特征,具有启发意义。

dc.description.abstract
The marriage and family laws of contemporary China and Russia have respectively moved towards different paths of returning to the civil code and maintaining independent codification. However,the huge institutional capacity and the inclusiveness of the social governance model of the Russian Independent Family Code also enable it to form unique and effective adjustment methods and experiences in dealing with social issues such as declining fertility rates,aging population,and loosening ties within nuclear families. Especially in considering the freedom of marriage and family stability,the pursuit of substantive equality between men and women,and the implementation of the principle of maximizing the interests of children,it has formed an important reference frame for the application and improvement of related systems in the Marriage and Family Chapter of China 's Civil Code. This reference reflects the return of Marriage and Family Law to the Civil Code and enjoys the benefits of general private law principles and system nourishment. At the same time,this reference has enlightened significance for how to prevent the unique ethical system characteristics that may be accompanied by the loss of independent legislative mode and weaken the unique characteristics of marriage and family law which differentiate it from the property law.
