党的十九大报告提出的建设现代化经济体系是互联网环境下对知识产权制度提出的新要求。互联网、人工智能的进一步发展亦对知识产权保护提出了新的挑战。关键核心技术的自主研发、获权过程中的循环诉讼、海外知识产权利益保护、滥用知识产权导致的司法资源浪费、知识产权行使中的国家安全等问题超出了传统知识产权保护制度规制的范围。知识产权治理可以弥补传统知识产权保护的不足。本文基于知识产权治理的理念,分析了知识产权治理的构造,探讨了知识产权治理的特质,廓清了知识产权治理的实践路径。

The 19th CPC National Congress Report proposes constructing a modern economic system, which has raised new requirements for the intellectual property system under the internet environment. The further development of the internet and artificial intelligence also poses new challenges to intellectual property protection. These problems are beyond the scope of traditional intellectual property protection, such as the sources of core technology, the circular litigations during right-grant, overseas protection of intellectual property interest, the waste of judicial resources from the abuse of intellectual property, and the national security issues during intellectual property practice. This paper bases on the idea of intellectual property governance,analyzes its construction and characteristics, and makes clear the practical approach.
