欧盟的民主化是欧洲一体化最近30年来的核心议题之一,是对一体化进程所导致的权力从国家层面让渡到欧盟层面所造成的合法性危机的回应。《欧洲宪法条约》被否决后,欧盟民主化的努力方向从增强欧洲议会的权力和角色转变为将成员国议会纳入欧盟的决策过程。然而,欧盟民主化的这一新路径并未有效回应欧盟民主赤字和合法性缺失的问题。本文从功能主义的路径出发,辅之以系统论的方法,对欧盟决策的民主控制机制中的欧洲议会、理事会和成员国议会的角色和问题进行分析,在对前述三个代议制机构的"代表、审议和反馈"功能进行审视的基础上,提出了成员国议会纳入欧盟决策程序后所导致的代议制机构的功能碎片化问题。最后,本文针对这一代议制机构的功能碎片化问题之解决方案提出了初步的探索。

  • The democraticalisation of the EU has been one of the fundamental issues of the recent thirty years' integration, responding to the legitimacy crisis caused by the facts the integration process has constantly transfers sovereignty powers from national to the Union level.After the aborted Constitution Treaty, efforts to advance the EU democracy has transformed from strengthening the powers and roles of the European Parliament to the involvement of national parliaments to the Union decision-making process.However, this effort does not respond effectively the problem of democratic deficit as well as lack of legitimacy.This article makes explorations on the roles and defects of the three representative institutions, the European Parliament, the Council and national parliaments from the functionalistic approached assisted by the System theory; on the basis of the review on the functions of“representation, deliberation and responsiveness”and these institutions, this article proposes the problem of functional fragmentation of the EU representative institutions caused by the involvement of national parliaments into Union decision-making process.Finally, this article makes preliminary research on the solution to this problem.
