论国家公园集体土地权属结构体系的供给困境与多元因应——以农村集体土地产权制度改革为契机

摘要：

完善的国家公园土地权属结构系实现国家公园内自然生态系统严格保护和自然资源永续利用的重要支撑。在中国由全民所有制和劳动群众集体所有制构成的社会主义公有制下,不同国家公园试点区内存在不同比例的集体土地,构建契合国家公园体制目标的集体土地权属结构体系,系建立完善的国家公园土地权属结构体系的关键。其核心在于实现集体土地权属结构与国家公园土地利用管制需求的供给均衡。源于国家公园内生态系统结构的复杂性、多样性等特点,国家公园内土地利用管制需求呈现出多元化的特征;然受制于集体土地产权制度,现有国家公园集体土地权属结构体系,呈现出对多元管制需求的供给不足。正在试点推进的集体土地产权制度改革为解决前述困境提供了历史机遇和制度空间,需在全面把握集体土地产权制度改革的基础上,考察借鉴域外国家公园土地权属结构的实践经验,证成国家公园集体土地多元权属结构体系与土地利用管制多元需求的契合性。进而在土地利用管制多元化需求的指引下,构建由集体土地征收、土地使用权流转以及保护地役权设置构成的国家公园集体土地多元权属结构体系,并明确其在未来国家公园立法中的规范表达方案。

  • Perfect land ownership structure of national parks is an important support for strict protection of natural ecosystems and sustainable utilization of natural resources in national parks. Under the socialist public ownership system consisting of ownership by the whole people and collective ownership by the working people, there are different proportions of collective land in different pilot areas of national parks. Building a collective land ownership structure system that meets the objectives of the national park system is the key to establishing a sound national park land ownership structure system.Its core is to achieve a balance between the ownership structure of collective land and the demand for land use control in national parks. Due to the complexity and diversity of the ecosystem structure in national parks, the demand for land use control in national parks is diversified; however, owing to the collective land property rights system, the existing system of collective land ownership in national parks shows insufficient supply of the demand for diversified control. The reform of collective land property right system which is being piloted provides a historical opportunity and institutional space to solve the aforementioned predicament. On the basis of comprehensively grasping the reform of collective land property right system, it is necessary to investigate and draw lessons from the practical experience of the land ownership structure of foreign national parks to prove the multi-ownership structure system and the multi-ownership structure of collective land in national parks. The compatibility of multiple demands of land use control. Then, under the guidance of diversified demand of land use control, the multi-ownership structure system of collective land in national parks, which is composed of collective land expropriation,land use right transfer and protection easement, is constructed, and its normative expression scheme in future national park legislation is clarified.
