摘要：

虚拟偶像在中国是新兴行业。因受某些城外行业惯例影响,忽视并损害该行业内声音权益主体正当利益的做法一直存在。随着《民法典》开启对声音权的法律保护,声音权益已过渡为声音权利,业内违反道德的一些做法已成为侵权行为。为治理国内虚拟偶像行业中侵害声音权的乱象,应当把握核心问题,通过"分级准入,渐次孵化"机制严控行业经营方准入;通过"弘扬法治精神及企业社会责任"强化经营权责意识;通过实现"互惠互利"改善授权体系。以此共同治理虚拟偶像产业中声音侵权问题,重构具有本土特色和高质量发展能力的产业生态。

  • Virtual idol is a new industry in China. Due to the influence of Japanese industry routine,the practice of ignoring and damaging the legitimate interests of sound rights subject in the industry has always existed.With the Civil Code opening the legal protection on the sound right,sound interests have been transited to sound rights,and some practices that violate morality in the industry have become violations. In order to control the chaos of infringing sound right in virtual idol industry in China,we must grasp the core issues:through the "hierarchical access,gradual incubation"mechanism strictly control industry operators access;through "promoting the spirit of rule of law and corporate social responsibility"Strengthening the consciousness of right and responsibility in operation; through"mutual benefit"improving the authorization system.In this way to commonly govern the sound infringement in the virtual idol industry,reconstruct the industrial ecology with local characteristics and high quality development ability.
