网络侵财犯罪数据驱动型侦查模式研究

网络的发展,在便利人们生活的同时,也为犯罪的滋生提供了土壤,网络犯罪以网络侵财犯罪为突出表现。网络侵财犯罪具有严重的社会危害性,刑事侦查工作亟需予以重视。从侦查模式的角度观之,则发现网络侵财犯罪在考验着侦查模式的适应性。网络侵财犯罪侦查工作中,传统侦查模式存在着侦查运行依赖人力投入、侦查决策倚重工作经验、侦查破案口供依赖性强这三个方面的局限。在大数据的时代背景下,侦查人员利用大数据积极寻求网络侵财犯罪侦查工作因应之道,则促使侦查模式演变为数据驱动型侦查模式。网络侵财犯罪数据驱动型侦查模式有着成熟的理论基础与迫切的现实需要。在网络侵财犯罪侦查工作中,数据驱动型侦查模式的适用表现为侦查思维指引下特定的侦查方法。

  • The development of the internet, while facilitating people's lives, also provides soil for the breeding of crimes. Cyber crime is prominently manifested by cyber crime. The cyber crime of property infringement has serious social hazards, and criminal investigation work needs to pay attention. From the perspective of the investigative model, we find that the cyber crime of property infringement is testing the adaptability of the investigative model. In the investigation of cyber crime of property infringement, the operation of investigation mode relies on manpower input, investigation decision-based work experience, and the investigation and cracking of crimes rely heavily on confession are three aspects' limits of the traditional investigation model. In the context of the era of big data, investigators use big data to actively seek ways to cope with the investigation of cyber crime of property infringement, which promotes the evolution of the investigation model into a data-driven investigation model. The data-driven investigative model ofcyber crime of property infringement has a mature theoretical foundation and urgent practical needs. In the investigation of cyber crime of property infringement, the application of data-driven investigation mode is manifested as a specific investigation method guided by investigation thinking.
