摘要：

宅基地制度基本功能的时代变迁对落实宅基地集体所有权提出了新要求。部分地方在推进宅基地"三权分置"探索中以宅基地集体所有权权能分解所形成的权利为主要抓手,积累了落实宅基地集体所有权的重要经验。立足实践,落实宅基地集体所有权须遵从宅基地"三权分置"的制度目标,坚持宅基地保障功能逐步向国家住房保障职责理性回归的改革方向,细化落实宅基地集体所有权的职责主体,构建落实宅基地集体所有权的三级权利体系并适时将相关权利纳入《民法典》《土地管理法》,从立法与政策、理论与实践两个维度实现改革探索的协同推进。

  • The change of the basic function of the homestead systems puts forward new requirements for the implementation of the collective ownership of the homestead. Some places in the promotion of the homestead "three rights division" exploration Some places have accumulated important experience in implementing the collective ownership of homesteads by taking the collective ownership of the homestead to break down the formation of the rights as the main grasp.
