《区域全面经济伙伴关系协定》(RCEP)的签订给衰退的全球经济带来希望。高水平的RCEP投资规则促进了投资自由化和便利化,但也存在缺少投资者与国家间争端解决机制等问题。RCEP为区域内投资营造了稳定的投资环境,提供了更低的市场准入门槛和全新的原产地规则,为投资者带来机遇。然而,在中美激烈竞争的背景下,RCEP区域内的投资者除了需要面对常规投资风险外,还面临着区域内其他缔约方的制裁、与《全面与进步跨太平洋伙伴关系协定》成员国投资者的竞争以及RCEP生效和落地过程中存在的不确定性。面对RCEP区域内的投资机遇与各种风险,中国投资者需要把握投资机遇,同时做好风险防控,在受到RCEP缔约方不公正对待时,应善于运用现有规则维护自身权益。

  • The signing of the Regional Comprehensive Economic Partnership Agreement (RCEP) brings hope to the declining global economy.High-level RCEP investment rules promote investment liberalization and facilitation,but there is also a lack of a dispute settlement mechanism between investors and countries.RCEP creates a stable investment environment for regional investment,and provides a lower market entry barrier and new rules of origin.RCEP brings opportunities to investors.However,in the context of fierce competition between China and the United States,investors in the RCEP region,in addition to facing conventional investment risks,also face sanctions from other countries in the region and challenges from members of the Comprehensive and Progressive Trans-Pacific Partnership Agreement.Chinese investors are also facing uncertainty in the process of entering into force of RCEP.Facing the investment opportunities and challenges in the RCEP region,Chinese investors need to seize the investment opportunities,and do a good job of risk prevention and control.When they are unfairly treated by the RCEP contracting parties,they should use existing rules to protect their rights and interests.
