党内法规评估作为党内法规治理机制的核心内容,既是发现立规不足、矫正执规偏差、提升施规实效的实践重点,也是理论界学术争鸣的关注焦点。通过对比分析中央与地方党内法规评估制度内容和重庆市两次党内法规评估工作,发现其实践需求与理论供给之间存在学理之"体"和实然之"用"错位的情况,主要表现为"多元参与"和"责任相关"的主体构成差异、"条文要素"和"时空条件"对象选择差异、"宏观全面"和"举要删芜"的指标设计差异、"单向落实"和"统筹兼顾"的成果运用差异。对此,应积极构建以需求为导向的党内法规评估的理论回归逻辑和实践应对策略:一是回归制度,以责任导向系统界分评估主体;二是回归价值,以问题导向全面覆盖评估对象;三是回归现场,以目标导向精准衡量评估指标;四是回归治理,以效能导向多重落实评估成果。

  • As the core content of the governance mechanism of the inner-Party regulations, the evaluation of such regulations is not only the practical focus of finding legislation defects, correcting the deviation in implementation and improving its effectiveness, but also the focus of academic debates. The analysis of the content of the"central—local"inner-Party regulation evaluation system and the summary of the two inner-Party regulation evaluation work in Chongqing yields the discovery of the disparity between academic basis and practical application, which is demonstrated in the disparity between plural participation and the responsible subjects, between textual factors and temporal-spatial conditions, between macro-comprehensiveness and indicator conciseness, and between one-way implementation and overall wholeness. This considered, a "return logic"and practical strategy are urgently needed for inner-Party regulation evaluation based on demands as follows: First, the return to the system for the evaluation subjects to be defined directed by responsibility; Second, the return to the value for the evaluation objects to be completely covered directed by actual issues; Third, the return to the scene for the evaluation standards to be precisely judged directed by targets; Fourth, the return to treatment for the evaluation of the outcome in a multiple manner directed by effectiveness.
