摘要:

随着平台经济的发展,互联网平台利用数据将其在一个市场的垄断力量延伸至另一个市场,进而获得杠杆优势,破坏另一个市场公平的竞争秩序,损害消费者利益。我国《反垄断法》采用原则性立法模式,规制互联网平台滥用杠杆优势行为面临困境。因此,需要革新规制方法和转换规制路径。具体而言,首先,明确供给作为"产品界定"标准,采用供给需求并重的替代性分析方法厘清互联网产品市场边界;其次,互联网平台市场支配地位的认定应分析用户数量、转移成本、关联市场力量、数据规模等因素;再次,将"不公平提高竞争对手成本"作为互联网平台滥用杠杆优势的行为要件;最后,反竞争效果分析应考量提高竞争对手获取用户注意力、数据的成本和降低隐私保护等因素。

  • In platform economy, internet platforms extend their monopoly power from one market to another by means of data so as to get leverage advantage, which disrupts the competition order of the new market and harms consumer's interest. The practice makes it impossible for Anti-monopoly Law, which adopts principle legislation model, to work effectively in regulating the misuse of leverage advantage. In view of this, regulation needs new ways. More specifically, firstly it should be made clear that supply is the standard to define products and, alternative analysis, which balances supply and demand, should be adopted to define the limit of internet product market; secondly, the identification of internet platforms' dominant positions should resort to analyzing user numbers, transference cost, the power of related market and the size of data; thirdly, the cost of unfair competition should be considered as a necessary condition to determine whether a platform is misusing leverage advantage; lastly, the analysis of anti-monopoly effect should take into consideration the increase of the cost of competitors' access to user's attention and data, and disclosure consumers' privacy.
