我国人才强国战略背景下的永久居留权制度研究

随着我国改革开放的不断深入,在全世界范围内招揽人才成为影响我国经济社会发展重要因素。全球化进程已经成为时代趋势的今天,我国要取得成功,就必须积极的拥抱全球化浪潮,不断对自身制度进行完善以适应全球化时代的需要。在全世界成为一个“地球村”的今天,生产要素的流动不再仅仅是局限在一个或者少数几个国家,而是在全世界范围内大量流动。劳动力资源也不例外。而我国由于过去发展程度不够,社会制度不健全,导致大量人才流失国外,人才的流入情况却很少。随着我国经济建设不断取得成功、基础设施日益完善,我国对国外人才的吸引力在逐渐增强,但由于我国人才制度的不完善,导致我国人才引进依旧差强人意。而永久居留权制度是全球人才市场的过滤器,我国要实现人才强国目标,就必须首先对我国当前的永久居留权制度进行改革和完善。在这一背景之下,笔者基于我国的人才强国战略对我国的永久居留权制度进行研究。本文总共分为五个部分,首先是绪论部分对本文的研究背景和意义进行论述,阐述人才强国战略对我国的重要意义,以及外国人永久居留权制度对于人才强国战略的实现之间的关系。第二部分是对相关概念进行界定。第三部分是对我国当前的永久居留权制度中与人才政策相关的部分进行分析,认为当前制度的不足主要有申请条件过高、待遇的规定不明确、缺乏相应的救济程序、管理体制混乱、缺乏永久居留与入籍之间的衔接程序、法律的效力层级太低等缺点。第四部分对美国、德国、俄罗斯的永久居留权制度中与人才引进政策相关的规定进行分析,主要从移民政策、管理制度和管理体制等方面进行分析。第五部分是基于我国永久居留权制度在发挥人才引进作用过程中所存在的不足以及国外永久居留权制度的相关启示和针对我国当前的实际情况,提出对我国永久居留权制度的完善建议。

For our country to succeed, it must actively embrace the wave of globalization and continuously improve its own systems to meet the needs of the globalization era. As the world has become a "global village", the flow of production factors is no longer limited to one or a few countries, but flows in large numbers all over the world. Labor resources are no exception. However, due to insufficient development in the past and imperfect social system in our country, a large number of talents are lost abroad, but the influx of talents is very small. With the continuous success of my country's economic construction and the increasingly perfect infrastructure, my country's attraction to foreign talents is gradually increasing. However, due to the imperfect talent system of our country, the introduction of talents in our country is still unsatisfactory. The permanent residency system is the filter of the global talent market. If my country is to achieve the goal of a powerful nation with talents, it must first reform and improve my country's current permanent residency system. Under this background, the author conducts research on my country's permanent residency system based on my country's talent strategy. This article is divided into five parts in total. The introduction part discusses the research background and significance of this article, expounds the significance of the strategy of strengthening the country by talents, and how the permanent residence system of foreigners can help the realization of the strategy of strengthening the country by talents . The second part is to define related concepts. The third part is an analysis of my country’s current permanent residency system, and pointed out the shortcomings of my country’s current system, mainly including high application conditions, unclear treatment regulations, lack of corresponding relief procedures, chaotic management systems, and lack of permanent residency Shortcomings such as the connection procedure with naturalization and the low level of legal effect. The fourth part analyzes the permanent residency system of the United States, Germany, and Russia, mainly from the aspects of immigration policy, management system and management system. The fifth part is based on the shortcomings of my country’s permanent residency system, the enlightenment of foreign permanent residency systems and the current actual situation in my country, and puts forward suggestions on the improvement of my country’s permanent residency system, mainly from improving relevant legislation and targeting overseas compatriots. Discuss on special regulations, reform management mechanisms, etc.
