摘要：

数字化时代的侦查研究已经成为近期的学术热点。基于《中国人民公安大学学报(社会科学版)》以及"法学核心期刊"(CLSCI)于2016年至2020年间刊出的相关文献可以看出,该领域研究在数字化刑事侦查的基础理论、电子数据的侦查取证程序、电子数据的侦查取证措施、多发疑难网络犯罪的侦查困境与对策、大数据侦查的基础理论与实践运用、跨境电子侦查取证与刑事司法协助等方面表现得较为集中。近期研究的兴盛受到了网络犯罪侦查需求、电子取证规范出台、侦查权力规制导向、跨境电子取证全球发展态势等多重因素的驱动,但还需要在基础理论研究的夯实、研究内容的扩展和深入、研究方法的优化改进方面继续推进。展望未来,数字化时代的侦查学术研究可以与智慧侦查战略、数据安全法治及数字人权保障等新兴主题深度融合,并力求实现本土化的理论自觉。

  • Investigation research in the digital era has become a recent academic hot spot. Based on the relevant literature published in the Journal of People 's Public Security University of China( Social Sciences Edition) and included by the China Legal Science Citation Index( CLSCI) from 2016 to 2020,it can be seen that this research field is more concentrated in the basic theory of digital criminal investigation,electronic data investigation and evidence collection procedures,investigation and evidence collection measures of electronic data,the investigation dilemmas and countermeasures of frequent and difficult cyber crimes,the basic theory and practical application of big data investigation,cross-border electronic investigation and evidence collection and criminal judicial assistance,etc.The recent flourishing of research has been driven by multiple factors such as the demand of cyber crime investigation,the introduction of electronic forensics norms,the regulation orientation of investigation power,and the global development trend of cross-border electronic forensics,but it still needs to be further promoted in the aspects of consolidating basic theoretical research,expanding and deepening research content and improving research methods.Looking to the future,the academic research on investigation in the digital era can be deeply integrated with the emerging topics such as intelligent investigation strategy,digital security rule of law and digital human rights protection,and strives to achieve theoretical self-awareness.
